RESOLUTION DECLARING THAT T~ PUBLIC USE,
BEEEFIT, SAFETY, ECONOMY AND GENERAL WELFARE
REQUIRES THE TAKING OF THE WHOLE OF A PARCEL
OF LAND FOR THE .WIDENING AND IMPROVEMENT OF
"H" STREET IN THE CITY OF BAKERSFIELD.
WHERFAS, on the 28th day of December, 1959, the Council of
the City of Bakersfield by Resolution No. 92-59, did declare that
the public interest and necessity requires the acquisition of 16!
feetof certain properties for the widening and improvement. of
"H" Street in the City of Bakersfield, and directing the City
Attorney ~o:ifile action for the acquisition of said property by
action in eminent domain, and
WHEREAS, since the passage of Said.resolution, this Council
has found and determined that the taking of a portion of a 'certain
parcel of land for said improvement would leave the remainder
thereof in such size and condition as to require the condemnor to
pay in compensation for the taking of such part an amount equal
to the fair and reasonable value of the whole parcel.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield, t'hat in accordance with the provisions of Section
1266 of the Code of Civil Procedure of the State of California,
it is deemed necessary for the public use, benefit, safety, economy
and general welfare in connection with the. widening and improvement
of "H" Street, between California Avenue and Brundage Lane in said
City, that the whole of the following described property be acquired
by said City by condemnation:
The east 60 feet of the South 38.25 feet of Lot 6,
and the east 60 feet of the north 20 feet of Lot 7,
in Block 33, of the "Resubdivision of Blocks 29, 30,
...... 31,¢31½, E; 1/2 of 32,~ 33'~ 33~!'bf¢ the~S0~thern .....
Addition" in Section 36, Township 29 South, Range 27
East, MoD.M., in the City of Bakersfield, County of
Kern, State of California, according to the map thereof,
filed in the office of the County Recorder of said
County, October 26,1909, in Book i of Maps atpages
.125-126.
