A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD FIXING A TIME AND PLACE FOR .HEAR-'
ING PROTESTS BY PERSONS OWNING REAL PROPERTY
WITHIN TERRITORY DESIGNATED AS "BENTON PARK
NO. 5", PROPOSED TO BE ANNEXED TO THE CITY OF
'BAKERSFIELD, CALIFORNIA.
WHEREAS,.a petition was.filed with the .Council of the City
of Bakersfield, on the 13th day of june, 1960, re'questing that certain
uninhabited territory therein descpiB'ed be annexedto and incorporated
within the City of Bakersfield, and
WHEREAS, said petition was signed bythe owners of all of the
territory proposed to be annexed.
NOW, THEREFORE, in compliance with the provisions of the Annexa-
tion of Uninhabited Territory Actof 1939, Chapter 297, as amended,
BE I~ RESOLVED by the Council of the City of Bakersfield,. as follows:
That the boundaries of the territory so proposed to be annexed
to the City of Bakersfield are described as follows:~
A parcel of land situate in the County of Kern, 'State of
California and being a portion of the west half (W. 1/2)
of the Southeast quarter (S. E. 1/4), of Section 12,
Township 30 South, 'Range 27 East, M. D. M.:
Commencing at the northeast (N. E.). Corner of ~he said west
half (W. 1/2), of the southeast quarter (S. E. 1/4), 'of
Section 12; thence southerly along.the easterly boundary
of the west half (W. 1/2), of the southeast quarter (S.E. 1/4),
.of said Section 12 to the southeast.(S. E.) corner of that.
certain annexation designated asBenton Park No. 3, as
same was adopted September.8, 1959, by 0rdina~ce No. 1259,
New Series, and which was Certified October 13, 1959by the
Secretary of State, State. of. California, and to the true
point of beginning of this description; thence westerly
along the corporate.boundary Of the City of Bakersfield
as same is defined by said Benton Park No. 3 to intersect
the westerly boundary of the southeast quarter of said
Section 12; thence southerly along 'last named westerly
boundary and departing from said corporate boundary, to
intersect ~ line parallel with, and distant southerly 1333.711
feet, asmeasured perpendicular to the northerly boundary

along last named parallel line, to intersect the easterly
botu~dary of the west half' (W. 1/2),"of'the southeast.quarter

aforesaid Benton Park No. 3,. andto the true point of begin-
ning, containing 17.0t7 acres of land more or less·
That a designation appropriately naming such' territory is
"BENTON PARK NO. 5"- "
'BE IT FURTHER RESOLVED, that Monday,' the 18th day of July,
1960, at the hour of eight o'clock P.M., in the Council Chambers of.
the City Hall, 1501 Truxtun Avenue, Bakersfield', california, is the
time when and the place where any person owning real property within
such territory so proposed to-be annexed and having any objection
to the proposed annexation may appear .before 'the Council 'of the City
of Bakersfield, and show cause why such territory should not be annexed.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the.City of Bakersfield at a regular
meeting thereof held on the 13th day 6f June, 1960, by the following
vote:.
