HomeMy WebLinkAboutRES NO 56-60RESOLUTION NO. 56-60 RESOLUTION PERTAINING TO PROCEEDINGS UNDER RESOLUTION OF INTENTION NO. 737 , , , , , WHEREAS, the City Council of the City of Bakersfield did on the 16th day of May, 1960, pass a resolution entitled, "Resolution of the City Council of the City of Bakersfield, California, Declaring Its Intention To Order the Improvement of Lakeview Avenue and all Intersections of Intersection Streets Between The North'Boundary of the Southern Pacific Asphalto Branch Right of Way and the North Line of 10th Street Within Public Improvement District No. 737~ in said City; Declaring the Work to be of More tha~ Local or Ordinary Public Benefit and Describing the District to be Benefited by Said Work and to Pay Costs and Expenses, and Fixing a Time and Place For Hearing Objections to Said Work." and a resolution entitled: "Resolution Adopting Plans and Specifications'In the Matter of the Improvement of Lakeview Avenue and All Intersections of Intersecting Streets Between the North Boundary of the Southern Pacific Asphalto Branch Right of Way and the North Line of lOth Street Within Public Improvement District No. 737 in the City of Bakersfield, California." and, WHEREAS, said Resolution of Intention was properly noticed for hearing'before the City Council at its Chambers in the City of Bakersfield, California, on June 6, 1960, at 8:00 P.M., and WHEREAS, a hearing thereon was had and was duly and properly conducted and at said hearing interested persons present and members of the City Council expressed the desire to increase the work set forth in the Plans and Specifications to include side- walks,.which resulted in an increase in the estimated cost of more than 10% of the estimate as shown in the Resolution of Intention, and, WHEREAS, it has been brought to the attention of the City Council by its legal advisor that there must be a new order adopting the changes in the plans and a new Resolution of Intention to include the changes in the Plans and Specifications and the new estimate, WILD. CHRISTENSEN. BARNARD & WILD ATTORNEY8 AT LAW FRESNO. CALIFORNIA NOW, THEEFOE, to allow for such changes in these proceedings, it is resolved that that certain resolution passed on May 16, 1960, entitled: "Resolution of the City'Council of the City of Bakersfield, California,_.Declaring Its'Intention to Order the Tmprovement of Lakeview Avenue and All Intersections of Intersecting Streets Between the North Boundary of..the Southern Pacific Asphalto Branch Right of W~y and the North Line of 10th Street Within PublicImprovement District No. 737, in Said~City; Declaring the Work to be of More than Local or Ordinary Public Benefit and Describing the District to Be Benefited by said Work and to Pay Costs and Expenses, and Fixing a Time and Place for Hearing Objections to Said Work.''· and that certain resolution passed May 16~ 1966, entitled, "Resolution Adopting Plans and S~ecifications in the Matter of the Improvemen~ of Lakeview Avenue and All Intersections Of Intersecting Streets Between the North Boundary of the SouthernPacific Asphalto Branch Right of Way and the North Line of lOthStreet Within P~blic Improvement'District No. 737 in th~ City of Bakersfield,_California" be, and they each are hereby rescinded.
