RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BAKERSFIELD" CALIFORNIA, CON-
FIRMING THE: ASSESSMENT FOR THE IMPROVE- ,
MENT OF CHESTER AVENUE BETWEEN 4TH
STREET AND 660 FEET SOUTH OF THE CENTER
LINE OF TERRACE WAY IN PUBLIC IMPROVEMENT
DISTRICT NO. 740 IN SAID CITY ,

WHEREAS, the City Counc'i1. of the City of Bakersfield did
adopt Resolution of Intention No. 740 for the improvement of
Chester Avenue between 4th Street and 660 feet s'outh of the
center line of Terrace Way, in Public Improvement District 740,
and
WHEREAS, pursuant to proceeding had and taken by said City
Council under said Resolution o'flntention No. 740, a contract,
was entered into by and between DICCO INC., 'as contractor, and

H. E. BERGEN as Superintendent of Streets of said City, for the
construction of said impr~veme~'s.. and
WHEREAS, the Superintendent of Streets prepared, signed and
filed with the City Clerk his assessment covering the costs and
expenses of the construction of'said improvements, and

WHEREAS, notice of the filing of said assessment has been

duly and regularly given by publication, posting and mailing, as
required by law, and said notice fixed the 14th day of December,
1959, at the hour of eight o'clock (8:00) P~M. and the chambers

of the City Council, located in the City Hall in the City of
Bakersfield, as the time and place when and where all persons,
, ,
interested in the work done or in the assessment, would be heard

CALIFORNIA, DOES HEREBY RESOLVE" DETERMINE, FIND AND OlillER AS
FOLLOWS:
That after a '. fair and impartial hearing having been granted
to all persons desiring to be heard in the matter of the said

improvement, described as aforesaid, in Public Improvement District
No. 740, and all objections presented, having been heard and fully
'considered, and the City Counc'il being satisfied with the correct- .
ness and ;fairness of the assessment and ,diagram, it is hereby deter-
mined that all appeals or objections be overruled and denied and
that the assessment and diagram, together with 'the proceedings, be
confirmed and approved and that the Superintendent of Streets shall
forthwith attach, a warrant to said assessment bearing the date of
this resolution of the City Council.

,I HEREBY CERTIFY that the foregoing resolution was duly passed
and adopted by the City Council of the City of Bakersfield, Cali-
fornia, on the 14th day of December, 1959, by the following vote:
