HomeMy WebLinkAboutRES NO 72-59RESOLUTION NO. 72-59 RESOLUTION OF THE COUNCIL 0F THE CITY 0F BAKERSFIELD, ORDERING THE VACATION 0F VARIOUS STREET3 AND ALLEYS SITUATE WITHIN TH~ CITY OF BAKERSFIELD, BEING A PORTION OF SECTION 30, TOWNSHIP 29 SOUTH, RANGE 28 EAST, M.D.M. WHE~A$, on the 8th day of September, 1959, the Council of the City of Bakersfield, pumeuant to the provisions of the "Street Vacation Act of 19~ll," beln5 Division 9, Part 3. (Sections 8300 ~t seq.) of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 745~ declaring its intention to order the vacation of various streets and alleys situate within the City of Bakersfield, Cmmty of Kern, ~tate of California, and being a portion of Section 30, Township 29 South, Range 28 East, M.D.M., and ~EREAS, said Council did fi:~ a time and place for hearing all persons interested in or objecting to said proposed vacation, which said heaving was held on the 28th day of Septeuber, 1959, after notices were duly posted as required by law, and WHEREAS, this Council after duly cons~ertng the matter, do~s hercby find and resolve as follows: 1. That those various streets and alleys situate within the City of Baxersfield, County of Kern, State of California, and being a portion of Section 30, Township 29 South, R~ge 28 East, M.D.M., more particularly described in Parcels A, B, C, and D, are unnecessary for present or prospective public ~trect pumposes: PkRC2~ A All of that 'portion of "R" ~treet of 82.~ feet in width, boarded on the north by the easterly, westerly prolongation of the southerly right-of-way line of 15th Street of 82.5 feet in width and bounded on the ~outh by the easterly, westerly prolongation of the northerly right-of-way line of lhth Street of 82.5 feet in width, and as said streets are shown on the "Map of the City of Bakersflsld," filed November 25, 1898, in the office of the County Recorder of said Kern County, in Book 1 of Maps at pages 13 and retaining all of the above described parcel of land for the pu~pose of a public utilities easement. ?ARCEL B All of that portion of 14th Street of 82.5 feet in width, bounded on the east by the northerly, southerly prolongation of the westerly right-of-way line of "R" ~treet of 82.5 feet in w~dth, and bounded on the west by the westerly right- of-way line of the Kern Island Canal, and as last named right- of~way~lfne~ is defined under "Parcel I" of "Resolution of Intention No. 692," adopted Februamy 18, 19~2, by the CounCil of the City of Bakersfield, ~nd recorded February 21, 1952, in Book 1904, at page 29, of Official Records, in the office of the said County Hecorder, and as said Streets amc shown on said "Map of the City of Bakersfield." All of that east and west alley of 33 feet in width in Block 346, bounded on the east by the northerly, southerly prolongation of the westerly right-of-way line of Street of 82.5 feet in width, and bounded on the west by the westerly right-of-way line of the Kern Island Camel and which last named right-of-way line is defined by that course and distance as "N. O1° 13' ~i3" W., 33.008 feet," under "Parcel II" of said "Resolution of Intention No. 692," and as said alley, street and block are shown on said "Map of the City of Bakersfield," retaining all of the above described parcel of land for the purpose of a public utilities easement. PARCEL D ~A1 of that east and west alley of 33 feet in width in Block 345, bounded on the east by the northerly, southerly prolongation of the westerly right-of-way line of Street of 82.5 feet in width, and bounded on the west by the northerly, southerly prolongation of easterly right- of-way line of "R" Street of ~2.5 feet in width, and as said alley, streets and block a~e shown on said "Map of the City of Bakersfield," retaining all of the above described pamcel of land for the purpose of a public utilitie~ easemen~o J. That said streets and alleys be and the same a~e hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 7~. Reference to said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this ~esolution and shall cause a certified copy he. eof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California.
