RESOLUTION OF TEE COUNCIL OF THE. CITY OF
BAKERSFIE, CALIFORNIA, CONFIP~MING THE
ASSESSMENT FOR TEE CONSTRUCTION OF SANI-
TARY SEWERS, TOGETHER WITH NANHOLES,' IAMP~
HOLES AND HOUSE CONNECTIONS IN CERTAIN-
STREETS WITHIN PROPOSED PUBLIC IIIPROVEMENT
DISTRICT NO. 739 IN SAID CITY.
WHEREAS, the Council of the City of Bakersfield did adopt
Resolution of Intention No. 739 for the construction of 6" sani~.ary
sewers of vitrified clay pipe in Myrtle Street, Pine Street, Cedar
Street and that alley lying between Brundage Lane.and..Eggers Street,
and the construction of 8" sanitary-sewers of~vitrifiedclay'pipe in
Brundage Lane and Spruce Street, ~ogether ~with~ manholes, lampholes
and house'connections in Public Impr0vementDtstrict 'No. 739~ and
WHEREAS, pursuant to proceedings.hadand'$a~ken by said 0ity
Council under said Resolution of IntentionINc. 739, a contract was
entered into by and between TROY CONTRACTORS, as' contraCtor,.and
H~ BERGEN, as Street Superintendent of said City, for the'construction
of said improvements; and
WHEREAS, the Superintendent of Streets prepared, signed and
filedwith'the City'Clerk his assessment covering the costs and expenses
of the construction of said improvementst and
~EAS, notice' of the filing of said-assessment'has been duly
and regularly given by publication, posting and-mailing,' as required
by law, and said notice fixed the 6th day of April, 1959, at·the ho,i~
of eight o'clock (8:00) P.M., and the chambers of the~Ci.ty~ Council,
located in the City Hall in the+ City of BakerSfield, as the .time and
place when and where all persons, interestedin(the work done or in
the assessment, would'be heard by the said'City Council;
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, FIND .AND ORDER AS FOLLOWS:' That after.a fair and impartial hearing having been granted
to all persons desiring to, be heard in the..'matter of the said
improvement, described as aforesaid,''! in.,Public Improvement District
No. 739, and all objections presented~ having been heard and fully
considered, and the City Council being satisfied with the correcthess
and fairness of the assessment and diagram, it is hereby determined
that .all appeals or objections be Overruled and .denied and that the
assessment and diagram, together with the proceedings, "be confirmed
and approved and that the Superintendent of' Streets' shall forthwith
attach a warrant to said assessment bearing the 'date of this reso-
lution of the-0ity Council.
.I HEREBY CERTIFY that the .foregoing Resolution ,was duly passed
and adopted by the Council of the City ~of +Bakersfield, at a.regular
meeting thereof held on the 6th day of April,.. 1959, by the following
vote: '
