HomeMy WebLinkAboutRES NO 9-59i~ESOLUTION NO..9-59 RESOLUTION ORDERING PREPARATION OF ESTIMATE OF COST, DISTRICT MAP, AND PLANS AhrD SPECIFICATIONS IN THE MATTER OF THE IMPROVEMENT OF CHESTER AVENUE BETWEEN 4TH STREET AND 660 FEET SOUTH OF THE CENTER LINE OF TERRACE WAY WITHIN THE PROPOSED PUBLIC IMPROVEMENT DISTRICT N0. 740, IN THE CITY OF BAKERSFIELD, CALIFORNIA. , , , , , , WHEREAS, the City Council of the City of Bakersfield has found and determined by no less than 4/Sths vote of all members thereof that public convenience and necessity require the doing of the improvement work and construction hereinafter described, as said determination is evidenced by Resolution No. 8-59 of this City Council of said City; and ~EREAS, under the provisions of Article XIII, Section 17 of the Constitution of the State of California and under the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931", being' Division IV of the Streets and Highways Code of.the State of California, in particu- lar Section 2804 of said Code, the said determination by this City Council of said City waives t~ie application of the other provisions of the said Special Assessment Investigation, Limita- tion and Majority Protest Act of 1931 in connection with said proposed improvement work and construction; and WHEREAS, this City Council of said City contemplates that said improvement work and construction be instigated under and in pursuance of an Act of the Legislature of the State of California designated as the "Improvement Act of 1911", as con- · tained in the said Streets and Highways Code; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield that the City Engineer of the said City be, and he is hereby ordered and directed to prepare an estimate of cost of, map of the district to be benefited by, and plans and specifications for the following improvement work and con- struction to be done in said City of Bakersfield, to wit: The improvement of Chester Avenue between 4th Street to 660 feet south of the center line of Terrace Way, said improvements to consist of the following: the removal of the existing pavement and reconstructing and resurfacing of street; the removal and replacement of portions of the existing Portland cement concrete Curbs, gutters, sidewalks and driveways; the removal and replace- ment of existing drainage structure. That all of the above improvement work and construction shall be of the sizes and dimensions and done in the manner and places and to the grades as shown and indicated on the plans and specifications therefor to be approved and adopted by this City Council of the City of Bakersfield. o0o I ITEREBY CERTIFY that the foregoing Resolution was duly passed and adopted by the City Council of the City of Bakersfield on the 9th day of February, 1959, by the following vote: o~te gity Council of the C;ty of Bakersfield, California -~ ~-~ ':~d~'~"['~P~j~ this 9th day of February 1959
