HomeMy WebLinkAboutRES NO 8-59RESOLUTION NO. 8-59 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, FINDING AND DETERMINING 'THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE CERTAIN IMPROVE~ENT WORK AND CONSTRUCTION ON CHESTER AVENUE BETI~fEEN .4TH STREET AND 660 FEET SOUTH OF THE CENTER LIh~E OF TERRACE WAY IN THE PROPOSED PUBLIC IMPROVEMENT DISTRICT NO. 740, IN THE CITY OF BAKERSFIE~LD. ~/~HEREAS, this City Council of the City of Bakersfield did, at a regular meeting of this City Council held on the 5th day of January, 1959, pass and adopt Resolution No, 1-59 , directing that a public hearing be had at this regular meeting of said City Council on this 9th day of February, 1959, where any person who might desire to hear or partake in the discussion in regard to the determination to be made by this City Council of said City as to whether public convenience and necessity re- quire the hereinsfter described improvement work and construction, could appear for said purpose; and WHEREAS, this City Council of said City is satisfied that notice of this hearing for said purpose was duly and regularly given as ordered in said Resolution; and WHEREAS, a public hearing before this City Council has been so held for said purpose at this appointed date, time and place therefor; and WHEREAS, all persons who appeared for said purpose were given the opportunity to be so heard; NOW, THEREFORE, the City Council of the City of Bakersfield, pursuant_~o~the provisions of-Article XIII,-Sectien 17--of the .... Constitution of the State of California, and pursuant to the pro- visions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931", being division IV of the Streets and Highways Code of the State of California, in particular Section 2~04 of said Code, DOES P~SOLVE. as follows, to wit: That after the giving of reasonable notice by publication, mail and posting and the holding of a public hearing as ordered by previous resolution of this City Council, this City Council, the legislative body of the City of Bakersfield, a chartered city in the State of California, finds and determines by no less vote than four-fifths of all of its members, that the public conven- ience and necessity require certain improvement work and construc- tion on Chester Avenue between 4th Street and 660 feet south of the center line of Terrace Way in the City of Bakersfield, Cali- fornia, the same being more particularly described as follows, to wit: The improvement of Chester Avenue between 4th Street to 660 feet south of the center line of Terrace Way, said improvements to consist of the following: the removal of the existing pavement and reconstructing and resurfacing of street; the removal and replacement of portions of the existing Portland cement concrete curbs, gutters, sidewalks and driveways; the removal and replace- ment of existing drainage structure. That, therefore, under the said provisions of the Constitu- tion and the Streets and Highways Code of the State of California, the terms and provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 shall not apply to the doing of said improvement work and construction or any pro- ceedings instigated or carried on in connection therewith, o0o- - -- I HEREBY CERTIFY that the foregoing resolution was duly passed and adopted by the City Council of the City of Bakersfield on the 9th day of February, 1959, by the following vote: Ex-officio Clerk of the City Council of the City of Bakersfield, California [ P~~s.~.t~day of Februsry, 1959.
