RESOLUTION NO.
83-58
RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DECLARING RESULTS OF SPECIAL
MUNICIPAL ELEC'l'IOll HELD IN SAID CITY ON
NOVEMBER 4, 195~.
WHEREAS, this Council duly and regularly called and provided
for the holding of a special election within the City of Bakersfield
on November 4, 1958, for the purpose of submitting to the qualified
voters of said City the following propositions:
PROPOSITION NO.1 (B)
TEMPORARY EMPLOYMENT. Adds Section 47.1 to the City
Charter which permits employment of persons for temporary
service in the several departments of the City for a period
not to exceed 120 working days in anyone department in any
period of one year.
PROPOSITION NO.2 (C)
QUALIFICATIONS OF COUNCILMEN. Amends Section 17 of the City
Charter by providing that members of the Council shall not be
interested in any contract, jOb, work or service for the
municipality, as such interest is or may be defined in Title 1,
Division 4, Article 4 of the Government Code of the State of
California.
PROPOSITION NO.3 (D)
OFFICERS APPOINTED BY THE COUNCIL. Amends Secti~'l 34 of the
City Charter by naming the officers to be appointed by the
Council, leaving out reference to the terms of office of
those officers who are under Civil Service, and dropping the
words ttPolice Judge" and "Public Welfare Commissioners".
PROPOSITION No.4 (E)
HEADS OF DEPARTMENTS. Amends Section 38 of the City Charter
by naming the officers of the City to be appointed by the
City Manager, leaving out reference to their terms of office,
and dropping the words "Health Officer".
PROPOSITION No.5 (F)
RESTRICTIONS UPON OFFICERS. Amends Section 46 of the City
Charter by making the State law as set forth in Title 1,
Division 4, Article 4, of the Government Code, which prevents
officers from having an interest in contracts made by them
in their wfficial capacity, applicable t. City offi&ers.
PROPOSITION No.6 (0)
ELECTIONS. Amends Sections 67, 72, 73, 75, 76 and 78 of
Article VII of the City Charter, relating to elections, to
wit: Fixing the time of nominating elections as the sixth

Tuesday prior to general elections; fixing the time between
sixty (60) and ninety (90) days before nominating election
to file nominat1ngpetition; fixing forty-five (45) days
before nomination election as time to present supplemental
petitions for nomination of candidate when original not suffic-
ient; fixing time at not later than forty (40) days before
nominating election as time to withdraw from nomination;
provides for Clerk to file petition of candidate not later
than forty (40) days before election; Clerk to certify list
of candidates not later than forty (40) days before election.
PROPOSITION NO. 7 (H}
ELIGIBILITY. Amends Section 146 of the City Charter to read
as follows: "Members of the Board of Education must be quali-
fied registered electers of the Bakersfield Scheel District
for three (3) years next preceding their election."
PROPOSITION NO. 8 (I)
DEPARTMENT OF PUBLIC WELFARE. Repeals Article VI of the City
Charter consisting of Sections 61, 62, 63, 64 and 65, which
provided for a Department of Public Welfare under the adminis-
trative control of a commission; for a Department of Public
Health under the control of a Health Officer; and for Depart-
ments of Public Charities and Parks and Playgrounds.
PROPOSITION NO.9 (J)
JUDICIAL DEPARTMENT. Repeals Article VII of the 01 ty Oharter
consisting er Section 98, 99, 100, 101, 102, 103, 104, 105,
106 and 107, which created a police court, prescribed its
jurisdiction and methods of appeal therefrom, set forth dispo-
sition of fines, set forth the qualifications of judge of said
court, and prescribed duties of police officers, all of which
are governed by State law.
PROPOSITION NO. 10 (K)
ICE A PUBLIC UTILITY. Repeals Section 133 of the City Charter
which declared ice to be a public utility.
PROPOSITION NO. 11 (L)
TEMPORARY EMPLOYMENT. Repeals Section (215) 8 of the City
Charter.

WHEREAS, by resolutions of said City and by order of the Board
of Supervisors of Kern County, said special election was ordered
consolidated with the State General Election held within said City
on said date, and said Board of Supervisors was authorized to canvass
the returns of said special election and t. certify the results to
this Council, and

WHEREAS, said special eleotion was duly held pursuant to
said orders of consolidation at the polling plaoes prescribed for
said state General Election, and the votes cast thereat were canvassed
and the returns thereof made as provided by law; and
WHEREAS, the said Board of Supervisors and the Clerk thereof
have duly canvassed the absentee ballots cast at said speoial election,
and said Board of Supervisors has adopted its resolution stating
the results of said special election and the Clerk of said Board has
entered in the records of said Board statements of said results, and
the Clerk has transmitted to the Clerk of this Council certified copies
of said resolution and said statements and the same have been presented
to this Council, and
WHEREAS, said Propositions Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10,
and 11, appeared on the ballots used at said election, as Measures B,
C, D, E, F, G, H, I, J, K and L, respeotively.
NOW, THEREFORE, the Counoil of the City of Bakersfield DOES
HEREBY RESOLVE, DETERMINE, AND DECLARE as follows:
1. That from the results of said special election certified
to this Council as aforesaid, it appears and this Council hereby finds
and declares that the total number of votes cast at the respective
election precincts established for said special election upon the
propositions stated in the recitals hereof and for and against said
propositions, the total number of absentee votes cast at saId election
upon said propositions and for and against said propositions, and
the total number of votes cast in said city upon said propositions
and for and against said propositions, are as set forth in said
Resolution of the Board of Supervisors of Kern County, California,
stating result of canvass of eleition returns of special munioipal
election of the City of Bakersfield held November 4, 1958, a copy of
which resolution is on file in the office of the Ci ty Clerk. That

enter in full on the minutes of this Council the aforementioned results
as hereinabove set forth.

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting
thereof held on the 8th day of December, 1958, by the following vote:
