and the City of Bakersfield to enter into an agreement, the terms of
which are. set forth in .that certain instrument entitled Agreement Re:
Separation of Grade which instrument sets forth certain obligations'
of the District and of the Cl~y~pertai~ing .to a separation. of grade
of Truxtun Avenue across State Highway Route 4, commonly known as U.
S. Highway No. 99 ~ and ' ·
WR~REAS, it is the understanding. of the parties to said agree-
mant tha~ other tomes and conditions may be added thereto to carry
out the full intent of said agreement.
NOW, THEREFORE, BE IT RESOLVED, 'by the Council of the City of
Bakersfield, as follows: ..
That the Mayor of the City of Bakersfield is hereby authorized
and directed to execute the aforesaid agreement with the 'Separation,
of Grade District, on behalf of the City of Bakersfield.
I _~mREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at.a regular meeting
thereof held on the 4th day of August, 1958, by the following vote:
