WHEREAS, it is the desire of the Separation of Grade District
and the 'City of Bakersfield to enter into an agreement, the terms of
which are 'set ~.orth in that certain instrument entitled Agreement Re:
Separation of Grade which instrument sets forth certain obligations
of the'District. and. of ~he.City,:~pertaining to a separation of grade
at the intersection ef the Southern PaCi.fic railroad tracks and the
extension of Beale Avenue, and'
W~R~AS, it is the understanding of the parties to said.agree-
ment'that other terms and conditions+ may>be added thereto to carry
out the.full intent of said agreement.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of
Bakersfield, as follows: ..
That the Mayor ef ~he City of Bakersfield is hereby authorized
and directed to execute the aforesai~'agreemenSwith the Separation
of Grade District, on behalf'of the Cityof Bakersfield7·

I HEREBY'CERTIFY that ~he foregoing'Resolutionwas passed and
