W]~EREAS, on the 'lTth day of December, 1956, the Council of the City of Bakersfield,'~'~rsuant to the prowls!one of the "Street Vacation Act ef 19~1", being Di~sion 9, Part 3, of the Streets and Highways Code of the State el:California, passed and adopted its Resolution of IntentlenNo. 729, declaring its intention to order the vacation ,f a portion ef UniOn:Avenue, in the City of Bakersfield, and WHEREAS, said Council: did fix a time and place for hea~ing all persons interested in or objecting to said proposed vacation, which said hearing was held on the.Tth day of January, 1957, after notices were duly postedas required by law, and WHEREAS, ~his Council after duly considering the matter, does hereby find and resolve as follows: 1. That ~hat portion of Union Avenue, also known as County Read No.+ 96,. as said Co~ty Road No. 96 was. declared a Public Highway, April 10, 1891, by the Beard of Supervisors of the County of Kern, State of California, as .shown in the minutes of said Board of Supervisors on file in the office of the County Clerk of-Kern County in Minute Book 5 at page 315, mere .particularly described as follows, is u~ecessary for present or prospective public street purposes: All of that port!on of Union Avenue, lying within the current corporate b~undary of the City of Bakersfield, and lying North of the following described line: Beginning at the Southeast corner of Section 18 Township, 29 South, Range 28 East, N. D. B. & M.; thence S. ~gcl0' 06' W., perpendicular te the Eastline of Said Section 18, a distance _of 57,YSfeet, tel a poin~ in the westerly right.~o£ way line of said Unio~'~venue;.o'£.~tI5.50 feet inwidth; thence N. 0° 49~;54"W., along .'last named westerly right of way line, parallel with the 's]aid-East line o~ Section 18,. on and along a current.existing .qorp~rate boundary of the City of. Bakers- field, as said corporate boundary is defined by Ordinance No. 984, 'New Series~ to-intersact the most northerly line of that certain parcel ef-land ..conveyed by the Kern County Land CemDany, a corporation, te the Pacific Improvement Company, a e'.er~perati0n, by. deed datOd'October 18, 1892 and recorded October 4, 1892,' in Book~' of Deeds, at page 134, in the of'fi~e. of the Cou~i~y. Rec~.~er 0~ the County of Kern, State of. California; thence' oon$in~ing N. 0° 49' ~'~ W., along lest named westerZy 'right 'of."wa line, and along said corporate :..' boundary "of'the Ci~,y Of~':I~a~ersfield, and parallel with said East line of Section 18,-.: sad along an easterly boundary line 162 for additional righ~ of ~ for Kern County Road No. 4, also known aa Manor Street, and as described in Case No. 66657, in the Superior C~urt of She Stslte of CalifoFnia in and for the 0ounty ef Ke~n, being I~OUd~Aty Of Kern, a political su~- division of the' Sta~e of California, Pla~.~tiff, versus Kern County Land Company, a corporation, and on file in the office of the Cottnty Iclerk ef said Kern Cnunty, a distance of 321.01 feet, to the~ true'point of beginning of this description~ thence ~. t~5e t~e,1 ~1" E.,~to and terminating at a point in the easterly righ~ ef way line of said Union Avenue, distant 57.75 feet easterly as measured perpendicular to said East lin of Section 2' That said portion of Union Avenue be and the same is hereby closed up, vacated ,and a~andoned for public street purposes, subject to and in conformity with the reservations and.exceptions contained in and cent.e~lated by said Resolution of Intention No. 729.
