NORTH AND SOUTH ALLE~f IN BLOCK 22, H01~k~R
PARK, AND A PORTION 0F 26th STREET~ IN SAID
CITY o
WHEREAS, on the 25th day of June, 1956, the Council of the
City of Bakersfield, pursuant to the provisions of' the "Street Vaca-
tion Act of 1941", being Division 9, Part 3, of the Streets and High-
ways Code of the State of California, passed'and adopted its Resolu-
tion of Intention No. 725, declaring its intention to order the vaca-
tion of the north and south alley inkBlock 22, Homaker Park and a
portion of 26th Street, in the City of Bakersfield, and
WHEREAS, said Council did fix a tLme and place for hearing all
persons interested in or objecting to said proposed'vacation, which
said hearing was held on the 16th day of July, 1956, after notices
were duly posted as required bY law, and
WHEREAS, this Council after duly considering the matter, does
hereby find and resolve as follows~
1. That the north and south alley in Block 22, Homaker Park
and said portion of 26th Street, in the City of Bakersfield, State of
California, more particularly described in Parcels A and B, respectively,
are unnecessary for present or prospective public street purposes:

All of that north and south alley of twenty (20) feet
in width, lying along the westerly side of Block 22, as

said alley is shown on map of ~Homaker Park~, recorded
April l, 1915, in the office of the County Recorder of
Kern. County, California, in Book 3 of Maps, at page 9-

All of the southerly 41.25 feet of 26th !Street, being the
southerly one-half of said 26th Street, bounded on the east
-by the prolongation of the westerly boundary line of Q Street;
bounded on the north by the center line of said 26th Street,
as said streets are shown on map of "Homaker Park~, recorded
April l, 1915, in the office of the County Recorder of Kern
County, California, in Book 3 of Maps, at page9; bounded on
the south by the northerly boup~dary Line Of Block 107, "Baker
Homestead", as said Block 107 is shown on "Map of the City
of Bakersfield" filed November 25, 1898, in the office of
said County Recorder, in Book i of Maps, at pages 13 and
l~; bounded on the west by the northeasterly right of way
line of Golden State Avenue, as said Golden State Avenue
was established by Decree of Condemnation, had in Case No.
25454, in the Superior Court of the State of California,
in and for the County of Kern~ ~ certified
copK of
Decree was recorded January 17, 1933, in Book 51, page
467, of Official Records, in the office of said County
Recorder; reserving and excepting from said vacation the
permanent easement and right at any time, or from time to
time, to construct, maintain, operate, replace, remove,
and renew sanitary sewers, and f~b~ther excepting and
serving from said vacation the easements and rights, if
'any, of public utilities, for the purpose of maintaining,
renewing and operating and replacing gas pipe lines, tele-
phone and power lines, and :~ater pipe lines, and other exist-
ing utilities.
2. That said north and south alley in Block 22, Homaker Park
and said portion of 26th Street be and the-same are hereby closed up,
vacated and abandoned for public street purposes, subject to and in
conformity with the reservations and exceptions contained in ~and con-
templated by said Resolution of Intention No. 725. Reference to said
Resolution of Intention is hereby made for further particulars.
3- The City Clerk shall certify' to-the passage of this reso-
lution and shall cause a certified copy hereof, attested by the Clerk
under the seal of the City, to be recorded in the Office of the County
Recorder of the County of Kern, California.
I H~EBY CERTIFY that ~he foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield, at a regular
meeting thereof, held on the 16th day of July~ 1956, by the following
vote:
