A RESOLUTION FINDl~G P~ND DETERMINING THE.
SUFFICIENCY OF A PETITION FILED IN THE F~AT-
TER OF PUBLIC IMPROVEMENT DISTRICT NO. 724.
WHEREAS, there was filed with the City Clerk of the City
of Bakersfield on the llth day of May, 1956, a petition from the
owners of property situated in the district described therein for
the following described work and improvement:
The construction of curbs and gutters
along the north and south side of a
proposed 36-foot roadway including curb
and gutter returns at the intersection
of Bank Street with L Street and N Street,
and
WHEREAS, the City Clerk has certified that she has compared
the signatures appearing on sai~ petition with the names of the
owners as shown on the last equalized assessment roll of the County
of Kern, and finds that said petition is signed by o~nners of property
described in said certificate, and.
WHEREAS, the City Engineer has reported to this Council
that the area owned by the persons namod on the aforementioned petition,
represents more than 60% of the total area of all property located
in the district described in said petition subject to assessment
for the proposed improvement described therein, and
~IEREAS, the City Council has duly considered said petition
and the certificates of the City Clerk and City Engineer with
reference to the proposed improvement referred to in said petition,
and the sufficiency of said petition.
NOW, THEREFORE, THE CITY CO~CIL OF THE CITY OF BM~RSFIELD
DOES HEREBY RESOLVE, DETERMINE, FDYD Ai~ ORDER as follows:
- 1. That the work and improvement referred to in said
petition is to be done under the provisions of the "~cprovement Act
of 1911", being Division 7 of the Streets and High~ays Code of the
State of California.
2. That this Council does hereby find and determine
that the qualified signatures to said petition, are the signstores
of all the owners of more than sixty per cent (60%) in area of
all the property subject to assessment for said wore and improvement.
3- That this Council does hereby further find and determine
that the said petition for said work and improvement complies with
all of the requirements of the "Special Assessment Investigation,
Limitation and Majority Protest Act of 1931~ being Division 4 of
the Streets and Highways Code of the State of California, and in
particular with the provisions of Section 2804 of said Code, and
the City Council intends to meet each end every condition and make
each and every finding necessary on its part in order to permit the
proceedings for said work and improvsnlent to go forward to com-
pletion without further reference to oF application of the provisions
of said Division ~ of the said Streets and High~.~ays Code.
4. That the proceedings for said work and improvement
shall be known and designated as Public .Improvement District No.. 724-
I HEREBY CERTIFY that the foregoing Resolution v~as passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 25t_~.h~ day of J~n~e_l. , !9~6, by
