HomeMy WebLinkAboutRES NO 61-55 RES'0LUTION N0.~'~ RESOLUTION OF PROPOSED ANNEXATION OF . UNINHABITED TERRITORY AND-SETTING TIME · FOR HEARING. WHEREAS, a petition was filed-with the Council of the City of 'Bakersfield on the 25th day of Augusta 1955, requesting that certain uninhabited territory therein described be annexed .to and'included within the incorporated limits of the City of Bakersfield, and that said territory be made a part of the Bakersfield City School District, and WHEREAS, said petition was .signed by the owners of not less than one-fourth (1/4) of the area "Of the land in such territ0ry,I and representing not less than one-foUrth (1/~) of the assessed Value~of such territory according to the last.prece*ding+equalized'assessment roll of the County of Kern. NOW, TH~REFORE, in compliance with the provisions of the Annexa- tion of Uninhabited Territory Act of 1939, Chapter-297, as amended, BE IT RESOLVEDby the Councilor the City of Bakersfield as follows: That the boundaries of theeterritory so proposed to be annexed to the City of Bakersfield and the Bakersfield City School District, are described as follows: That portion of the East-half of the Northeast quarter of Section 12, Township 30 South, Range 27 East, Mouct Diabto Base and Meridian, in the. County of Kern~ State of California, more particularly described as follows: Beginning at the intersection of the Easterly extension of the.Northerly line of Lot 107, asksaid Northerly line of · said LotlOT is shown on the map of Tract No~I1785 recorded February 3, 1955 in Book 8, Page 184 of Maps, in the office of the County Recorder of Kern County, with the Westerly line of South 'H" Street, also known·as Kern Island Road of 60 feet in width, said intersection also bears North89° 55~22'' West, · 30,00 feet distant· from theEasterly line Off. Said East~half of'-the~NortheaStquarter of~ISect~on~ 12;-~ thence·.North-89o~55,. distance o 5.00 feet to a point in the Easterly line of Lot 90 of-said Tract No. 1785~ thence North 0o 00, 07" West,.. along the Easterly line of said Lot 90 a distance of 10.00 feet to the Northeast cornerror said Lot 90; thence North 89oI 55' 22" West along the Northerly' line of said LOt 90~.'a distance of 129.25 feet to intersect the Westerly line of the said East-half of the Northeast quarter of Section 12, the last named intersection being also thel S0uth~est corner of Lot 7, as said Lot 7 is sho~n on map~' of .Tract No. 1788, re- corded June 9, 1955 in Book 8~. Page 197 of Maps in the office of the said County Recorder; thence North 0° 00~ 52" West on and along the Westerly boundary of said Tract No. 1788, a distance of ~7-50 feet to the Northwest corner of Lot l, as said Lot i is shown on map of said Tract No. 1788; thence South 89° 57' 22" 'East, a Idistance of 363-19 feet to the Southwest corner of Lot 72, as said Lot 72 is sho~-n on map of said~ Tract No. 1788; thence North 0° 00~ 52" West, a distance of 329.84 feet to.intersect the Northerly line of the right of way of Ming Road ~of. 60 feet l in width said North line being distant 30 feet Northerly as measured at right angles to the North line of the Northeast quarter of Section 12, Township 30 South, Range 27 East, Mound Diablo Base and Meridian; thence South 89° .57' 22" East on and along said Northerly right of way line~ a distance of 931-255 feet more or less to intersect the Westerly line of South "H" Street, said Westerly line of South "H'~ Street being distant 30 feet West as measured at right angles to the East boundary line of the Southeast quarter of Section l, Township 30 South, Range 27 East, Mount Diablo Base and Meridian, said Westerly line of South "H" Street also being Corporate Boundary of the City of I Bakersfield; thence South and' parall~el with the East boundary line of said Section I a distance of 30 feet to a point in the North boundary line of said Section 12, said point bears North 89° 57' 22" West distant 30 feet from the Northeast corner of said Section 12; thence South 0° 00' 07" East, along a line parallel with and 30.00 feet distant Westerly as measured perpendicular to the Easterly line of said East-half of the Northeast quarter of Section 12, and on and along the corporate boundary of the City of Bakersfield as said corporate boundary is defined in Ordinance. No. 898, New Series, adopted January 2, 1951, 'by the Council of the City of Bakersfield, and certified February 5, 1951, by the. Secretary of State, State Of California, a di'stance 758.09 feet more or less to the .point of beginning. That a designation appropriately identifying such Iterritox~J is BENTON PARK. That said territory shall, upon annexation to the City of Bakers- field, be within and become a part Of ~he Bakersfield City School Distrtct~ pursuant to Section 2421-5 of the Education Code. BE IT FURTHER RESOLVED that Monday, the 3rd day of October, 1955, at the hour of eight o'clock P.M., in the Council Chambers of the City Hali~'I501 Truxtun-Avenue~ Bakersfie~d, California, ~is~the time when and the place where any person o~ning real property within such territory so proposed to be annexed and having any objections to the · proposed annexation may appear before the Council of the City of BakerSfield and show cause why such territory should not be annexed.
