HomeMy WebLinkAboutRES NO 53-55 P~SOLUTION NO. 53-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, ~INDING AND DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE CERTAIN IMPROVEMENT WOE ~ND CONSTRUCTION IN AN ALLEY IN TRACT NO. 1532 LOCATED BETWEEN ENCINA AND "F!' STREETS AND BETWEEN 24TH AND 26TH STREETS WITHIN THE PROPOSED PUBLIC IMPROVEMENT DISTRICT NO. 714, IN THE CITY OF BAKERSFIELD, CALIFORNIA *** WHEREAS, this City Council of the City of Bakersfield did, at a regular meeting of this City Council held on .the 18th day of July, 1955, pass and adopt Resolution No 49-55 directing · , that a public hearing be had at the regular me~ting of said City Council on the 1st day of August, 1955, which was duly continued to this regular meeting of said City Council on this 8th day of August, 1955, where any person who might desire to hear or partake in the discussion in regard to the determination to be made by this City Council of said City as to whether public convenience and neces~ty require the hereinafter described improvement work and construction, could appear for said purpose; and WHEREAS, this City Council of said City is satisfied that notice of the hearing for said purpose was duly and regularly given as ordered in said Resolution No. 49-55 ; and WHEREAS, a public hearing before this City Council has been so held for said purpose at this appointed date, time'and place therefor; and WHEREAS, all persons who appeared for said purpose were given the opportunity to be so heard; NOW, TEEORE, the City Council of the City of Bakersfield, pursuant to the provisions of Article XIII, Section 17 of the Con- stitution of the State of California, and pursuant to the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 19Bl", being DiviSion IV of the Streets and.Highways Code of the State of California, in particular Section 2804 of said Code, DOES RESOLVE as follows, to wit: That after!!~the giving of reasonabide notice by publication, mail and posting and the holding of a public hearing as ordered by previous resolution of this City Council, this City Council, the legislative bodyof the City of~Bakersfield, a chartered city in the State of California, finds and determines by no less vote than four-fifths of all of its ~embers, that the public convenience and necessity require certain improvement work and construction in the alley in Tract No. 1532, located between Encina and F Streets and between 24th and 26th Streets in the City of Bakers- field, California, the same being more particularly described as follows, to wit: The improvement of an alley in Tract No. 1532, located between Encina and F Streets and between 24th and 26th Streets, the improvements to con- sist of the following:'The removal of the existing bituminous surface treatment and asphal- tic concrete paving and the repaving with 5 inches of plant-mixed surfacing to be placed on 4 inches of imported borrow; the construction of a Portland cement concrete center drain and the removal and reconstruction of the existing c'ross gutter in 24th Street. That, therefore, under the said. provisions of the Consti- tution and the Streets and HighwaYs Code of the State of Calif- ornia, the terms and provisions o~ the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 shall not apply to the doing of said improvement work and' construction or any proceedings instigated or' carried on in connection there- with. ---'o0o--- .I HEREBY CERTIFY that the foregoing resolution was duly passed and adopted by the City Council of the City of Bakersfield on the 8th day of August, 1955, by the following vote: AYES: CARNAKIS, I, CROES, DOOLIN, EVELETH, SCHWEIT?.ER, SULLIVAN.
