WHEREAS, on the 31st day of May, 1955,.the City of Bakers-
field. entered into an agreement with the Southern Pacific Company,
providing for the installation ~and maintenance of flashing light
grade crossing signals at 24~h Street and the Southern Pacific
Company tracks, in said City of Bakersfield, and
WHEREAS, under Statutes of 1953, Chapter 1739, City is
permitted to apply to the Public Utilities Commission for a refund
of one-half of the costs paid by City for the improvement above-
mentioned, from the Crossing Protection Fund.
NOW, THEREFORE', BE IT RESOLVED by the Council of the City
of Bakersfield, as follows:
1. That the Council of the City'of Bakersfield hereby aUthor-
izes the filing of a request for allocation of funds from the Crossing
Protection Fund,.with the Public Utilities Commission.
2. That. City hereby declares and holds the State of Cali-
fornia'freefrom damages resulting from the construction of the
abo~e-mentioned project, and the maintenance and operation of the same.
3. That the Mayor of the City '-of Bakersfield is.hereby
authorized to sign said request for allocation of funds-.

I HEREBY CERTIfY that the'foregoing Resolution was passed and
adopted hy the'Council of the City of Bakersfield at a regular meet-
ing thereof heldonthe'18th-day of July, 1955, by the following vote:
