HomeMy WebLinkAboutRES NO 11-55RESOLUTION NO. 11-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, FINDING AND DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE CERTAIN IMPROVEMENT WORK AND CONSTRUCTION ON F STREET BET~'~EEN 19TH STREET AND 24TH STREET IN THE PROPOSED PUBLIC IMPROVEMENT DISTRICT N0. 709~ IN THE CITY OF BAKERSFIELD. WHEREAS, this City Council of the City of Bakersfield did, at a regular meeting of this City Council held on the 31st day of January, 1955, pass and adopt Resolution No. '4-55 , directing that a public hearing be had at this regular meeting of said City Council on this 14th day of February, 1955, where any person who might desir~ to. hear or partake in the discussion in regard to the determination to be made by this City Council of said City as to whether public convenience and necessity re- quire the hereinafter described improvement work and construction, could appear for said purpose; and WHEREAS, this City Council of said City is 'satisfied that notice of this hearing for said purpose was duly and regularly given as ordered in said Resolution No. ~55 i and WHEREAS, a public hearing before this City Council has been so held for said purpose at this appointed date, time and place therefor; and ~ WHEREAS, all persons who .appeared for said purpose were given the opportunity to be so heard~ NOW, THEREFORE, the City. Council of the City of Bakersfield, pursuant to the provisions of Article XIII, Section l? of the Constitution of the State of California, and pursuant to the pro- visions of the "Special Assessment InVeS~liga~io~, Limitation and Majority Protes~ Act of 1931",~being Division IV of the Streets and Highways Code of the Sta~e! of California, in particular Section 2804 of said Code, DOES RESOLVE as follows, to wit: That after the giving of reasonable notice by publication, mail and posting and the holding of a public hearing as ordered by previous resolution of this 'City Council, this City Council, the legislative body of the City of Bakersfield, a chartered city in the State of California, finds and determines by no less vote than four-fifths of all of itsimembers, that the public conveni- ence and necessity require certain improvement work and construc- tionon F Street between 19th Street and 2~th Street.in the City of Bakersfield,California., the same being more particularly de- Scribed as follows, to wit: The improvement of F Street between the center line of 19th Street and the center line of 24th Street, including the follow- ing: thee;widening and resurfacing of the existing pavement between 19th Street and 21st Street; the.removal of the existing oiled surfacing between 21st and 24th Streets and the widening. and repaying of the roadway with 4 inches offplant-mixed surfacing; the removal of existing P.C.C. curb, gutter and sidewalk and:the reconstruction to provide the additional roadway width; the construction of additional curb, gutter and sidewalk; the removal of.existing culverts and their replacement with larger culverts and the construction of an additional catch basin, Junction box and pipe Connections fto the existing storm drain in 23rd Street. That, therefore, under the said provisions of the Constitution and the Streets an8 Highways Code of the State of California.,' the terms and provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 shall not apply to the doing of said improvement work and.construction or any proceedings instigated or carried on in connection therewith. o0o I HEREBY CERTIFY that :the .foregoing resolution was duly passed and adopted by the City Council of the City of Bakersfield on the ing vote: day of February, 1955, by the follow- o~ the City Council of the City of Bakersfield, California APPROVED this ] "bL'~ day of February, 1955-
