HomeMy WebLinkAboutRES NO 50-65RESOLUTION NOo :~0~-65 A RESOLUTION OF THE C~TY OF BAKERSFYELD CALLING A SPECIAL ELECTION TO BE ~.~LD ON THE 2ND DAY OF NOVEMBER~ 1965~ PERTAINING TO THE ANNEXATION OF MING NO o 3 TO T~E CZTY OF BAKERSFIELD~ ESTABLXSHING VOTING PREC~NCT~ POIJ~NG PLACE AND OFFICERS OF ELECTS-ON FOR SAID ELECTION~ AND PRESCRIBING FEES TO BE PAID TO SA~D OFFICERS OF ELECTION AND FOR SA~D POLLXNG PLACE° WHEREAS, a written petition was filed with the Council of the City of Bakersfield~ requesting that ~ertain inhabited territory therein described be annexed to the City of Bakersfield~ and WHEREAS, by ~esolution Noo ~0~65, the Council of the City of Bakersfield declared its intention to call a special election in certain inhabited territory contiguous to said city proposed to be annexed to said.city~ for the purpose of submitting to the qualified electors residing in said territory the question ~hether or not said territory shall be annexed to said city-, and setting forth a time and place of hearing protests against said proposed election~ and WHEREAB~ a copy of said resolution was published as required by law; and W~EREAS~ prior to and at the time set for hearing protests to the proposed election written protests were not ma__de by owners of oneshalf of the value of the territory proposed to be annexadD as shown by the last equalized assessment roll and no protest was made by public and private owners equal to oneshalf of the value of said territory~ and WHEREASs all proceedings have been had in accordance with said resolution and the Annexation Act of 1913~ reference thereto hereby being made for further particulars° NOW~ THEREFORE~ BE IT RESOLVED by the Council of the City of Bakers field ~ as follows~ SECTIOR 1o A special election is hereby called to be held on the 2nd day of Novemberp 1965~' in the territory hereinafter described' and proposed to be annexed to the City of Bakersfieldp for the purpose of submitting to the qualified electors residing in said territory the question whether or not said territory shall be annexed to the City of Bakersfield and the property in the territory to be annexed be subjected to taxation after annexation equally with the property within the Oity of Bakersfield~ to pay the bonded indebtedness of the City of Bakersfield outstanding for the acquisition~ construction or completion of municipal improvements° SECTION 2o That said territory is hereby designated and identified for such election purposes and for use upon the ballots at such election as "MINC NO~ 3" and is. described as follows: A parcel of land situate in the County of Kern, State of Califormia~ and being a portion of the southwest quarter <SW1/4) of Section 1, Township 30 South~ Range 27 East~ MoDoM: Beginning at the southeast corner of Lot 44, as said Lot 44 is shown on the '~Kera.County Sales Map Noo i of Lands of Jo ~o Haggin'' filed for record May 3~ 1889, in the office of the County Recorder of said Kern County~ said southeast corner being a point on the northerly right of way line of Ming Avenue~ and also being a point on the corporate boundary of the City of Bakersfield as defined by Ordinance No. 1299~ New SeriesZ Y ENCE (l) westerly along the said northerly right of ~ay line of Ming Avenuep along the corporate boundary as defined by Ordinance No, 1299 and 1473~ New Series, and along' the westerly prolongation of said northerly right of way line to intersect the westerly right of way line of Cas~ro Lane~ of 60 feet in width~ along CourSes 29 through 27 of said Ordinance Noo 1473 New Series, as follows: Course <29)c southerly along the said westerly right of way line of Castro Laneo a distance of 5 feet more or less~ to intersect the northerly right of way line of Ming Avenue~ THENCE (3) westerly along Course (28) to intersect Course said Course (27) being the west line of a parcel of Q land~ deeded to the Keyset Broso Trucking Company recorded January 21, 1964~ in Book 3683 at page 819 of the Official Records of said Kern County; T E CE (4) Course (27)c NoO°45923"Eo~ 500 feetp more or less~ to the northwest corner of last named parcell $.89°58~24~Eo~ 87o12 feet, departing from the corporate boundary, along the north line of said last named parcel to the northeast corner thereofD said northeast comer also being the northwest corner of Tract Noo 2396 as said Tract Noo 2396 is shown on the map recorded' August 3~ 1961, in Book 12 of Maps at page 46 in the office of the said County Recorder~ (6) $o0~08~54~o~ 275°00 feet along the west line of said Tract No. 2396 to 'the southwest corner thereof~ Ta CE S.89°56'56'~Eo, along the south line of said Tract No. 2396 and the easterly prolongation thereof to intersect the easterly right of way line of Castro Lane~ said east right of way line being the west line of aforesaid Lot 44~ northerly along the said west line of Lot 44 to intersect the north line of the south 351 feet of said Lot 44 as defined by the grant deed to Howard R. The polls at said election shall be opened at 7 o~dlock AoMo of the day herein fixed for the holding of said election and shall be kept open until 7 o~c!ock P°Mo~ of the same dayD when the polls shall be closed° S~CTIO~ 4o Upon the ballots to be used at said election there shall pr~n~ed the words: S~LL '~MING NOo 3' BE ANNEXED TO TEE CiTY OF BAKERSF~ELD AND THE PROPERTY XN SUCM TERRITORY BE~ AFTER SUCMANNEX~ ATION~ SUBJECTED TO TAXATION EQUALLY WITH THE PROPERTf WITHIN THE. CITY OF BAKERSFIELD~ TO PAY THE BONDED XNDEBT~ EDNESS OF THE CETY OF BAKERSFIELD OUTSTANDING FOR T~ME ACQU~SYTIONo CONSTRUCTION OR COMPLETION OF MUNICIPAL ~MPROVEMENTS? Opposite these words there shall be printed the words and ~NOn~ and to the. right of each of these last two words there shall be a voting square° ~f an elector shall stamp a cross <+) in the voting square after the printed word ~Yes~' the vote of such elector shall be counted in favor of the annexation of said ~erri~ tory to the City of Bakersfield; and if an elector shall stamp a cross (+) in ~he voting square after the printed word ~No~v the vo~e of such elector shall be counted against such annexation° In all particulars not herein recitedSaid election shall be held in confoz~mity~ as near as may beD with the la~qs of the State of California concerning general elections and with said Anmexation Act of 1913° SECTION 5o <a) For the purpose'of said election there is hereby established in the territory proposed ~o be annexed~ one <1) voting precinct consisting of a portion of Precinct Baldwin No, 3, which shall include all of said territory° The following is the polling place of said election precinct and the following named persons are hereby named officers of election and shall constitute the board of election for such election precinct: POLLING PLACE: Eloise Ro Cave garage' 2710' Mine Avenue Bakersfield, California INSPECTOR: JF~GE: Eloise Ro Cave Betty L o Lamond Audrey Potter (b) For their services in connection with said e!ectionp said ~nspector shall receive $27°00 and said Judges shall receive $24°00 each~ and the person in possession of the polling place named heroin shall receive for the use of such premises in connection with said election the sum of $24°00° SECTION 6o The City Clerk shall publish a notice of said special election as required by the Annexation Act of 1913~ at least once a week for the four ~4) weeks prior to the election~ in the Oildale ~ews~ a newspaper of general circulation~ printed and published outside the city~ but in the county in which the territory is situated° ......... o0o ......... % ~EBEBY CBEtTYF~ that the foregoing Ordinance was passed and adopted by the ~ouncil of the City of Bakersfield at a ~eg~lar meeting thereof held on the 23rd day oE Augus~ 19659 by the following vote% ABSTAINING COUNCILMEN: Council of ~he City oE Bakersfieldo
