AN AMENDMENT TO THE CONTRACT ·BETWEEN.·
THE BOARD OF ADMINISTRATION OF THE
STATE EMPLDYEES' RETIREMENT. SYSTEM
AND THE CITY COUNCIL. OF THE. CITY OF
· BAKERSFIELD :'
WHEREAS, the S~ate Employees'~.Retirement Law permits
~he par.tici'pation of public agencies and ~heir employees in-t'he
State'Employeest .Retirement System by the execution· of a contract,
.and sets f0rththe procedure' by.which said'public'agencieS·.may elect.
'to subject 'themselves and their empiDyee's'to amendments ~o said. law; and
WHEREAS,' Seqtion20497 of the GoVernment Code 'provides
that a 'contract between a'public a'gency ana' the BOard'of Adminis~-'
tration may be'amended to modify.b~nefitsand adjust contributiOnS
if the California State Social Security Agreement of-March 9, 1951,
is modified to.include employees o~"the'public'agenCy in positions
covered. by the System~'.'and
· WHERE~S~ Federal'and StaGe'law permit the present members
('other than members in police tYpe. poSitions).of'a ret'irement system
to Choose individually whether they wish to beCov'ered byFederal.

: WHEREAS~ it is the intention of.~this governing ~body to
allow 'employees of thislagency to exercise Such choic'e and, furthers.
~o 'provide an appropriately modified program of Retirement System
benefits and Contributions.for such. employees as elect'to be.covered
by Federal Otd-Age~ Surviv0rs~.andDisability Insu~ance~ and'
WHEREAS, one step required'in.proCedUres for contract
amendment is the adoptionby the governing-body of a pubiic agency
of a Res'ol.u~i~n of intention givlngjnotice.of intention to amend

L NOW~ ·THEREFORE BE ITRESOLVED.~. That the City Council Of
the City of Bakersfield gives, and ·i~ does ·hereby give ·notice of
intention to amend 'its contract· between said City. Council and the
Board of Adm'inistra~ion of the State Employees~ 'Retiremen~ System
to provide for a modification of benefits· 'a~d ~adj.ustm'ent .of rates,
a summary.of the major provisions of' the mOdification,.and a copy
Of said amendment being attached here·to marked "exhibits A and B"
respectively, and by ·this reference' made a part hereof.
