'41-64' RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, CONFIRMING THE ASSESS- MENT FOR THE CONSTRUCTION AND PAVING OF STREETS, INSTALLATION OF CURBS, GUTTERS AND SIDEWALKS AND CONSTRUCTION OF A CULVERT IN PUBLI-C IMPROVEMENT- DISTRICT NO. 777, IN SAID CITY AND IN THE COUNTY OF KER-N. WHEREAS, the City Council of the City of Bakersfield did adopt Resolution of Intention No. 777a for the construction of improvements in Public Improvement District 777; and WHEREAS, pursuant to proceedings had and taken by said City Council under said Resolution of Intention No. 777a, a contract was entered into by and between PHEONIX CONSTRUCTION CO., INC., and H. E. BERGIN, as Superintendent of Streets of said City, for the construc- tion of said improvements; and WHEREAS, the Superintendent of Streets prepared, signed and flied with the City Clerk his assessment covering the costs and expenses of the construction of said improvements; and WHEREAS, notice of the filing of said assessment has been duly and regularly given by publication, posting and mailing, as required by law, and said notice fixed the 15th day of June, 1964, at the hour of eight o'clock (8:00) P. M. , and the chambers of the City Council, located in the City Hall in the City of Bakersfield, as the time and place when and where all persons, interested in the work done or in the assessment, would be heard by the said City Council; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, FIND AND ORDER AS FOLLOWS: That after a fair and impartial hearing having been granted to all per. sons desiring to be heard in the matter_of.the said improvement, described as aforesaid, in Public Improvement District No. 777, and all objections presented, having been heard and fully considered, and the City Council being satisfied with the correctness and fairness of the assessment and diagram, it is hereby determined that all appeals or objections be over- ruled and denied and that the assessment and diagram, together with the proceedings, be confirmed and approved and that the Superintendent of Streets shall forthwith attach a warrant to said assessment bearing the date of this resolution of the City Council. - -o0o I HEREBY CERTIFY that the foregoing resolution was duly passed and adopted by the City Council of the City of Bakersfield, California, on the 15th day of June, 1964, by the following vote: AYES: COUNCILMEN: BALFANZ, DO~LIN, MAI{C~4~Ai'4:~, I,A.~';&~M'.:~,t. ~"~G~,%.~{, ~FI~RN.
