IN-~PROPOSED PUBLIC. IMPROVEMENT DISTRICT
N0. 77.
WHEREAS, this City Council of the City of Bakersfield,
did, at a regular meeting of this City Council held on the
3rd day of September, 1963, pass and adopt Resolution No. ?3-63
directing that a public hearing be had at this regular
meeting of said City Council on this 16th day of September,
1963, where any person who might desire to be heard and to
take part in the discussion in regard to the determination
to be made by this City Council as to whether public con-
venience and necessity require the hereinafter described im-
provement work and construction, could appear for said purpose;
and
WHEREAS, this City Council of said City is satisfied
that notice of this hearing for said purpose was duly and
regularly given as ordered in said Resolution; and
WHEREAS, a public hearing before this City Council has*
been so held for said purpose at this appointed date, time
and place; and
WHEREAS, all persons who appeared for said purpose were
given the opportunity to be so heard;
NOW, THERE~0RE, the City Council of the City of Bakersfield,
pursuan~ to the provisions of Article XIII, Section iF of the
'Constitution of the State of California~ ~an'd pursuan~ to the l
provisions of the "Special Assessment Investigation, Limitation
and MaJority Prote~t Act of 1931", being Division IV of the Streets
and Highways Code of the State of California, does hereby resolve

as follows, to wit:
That after the giving of reasonable notice by publication
and p~sting and the holding of a public hearing as ordered
by previous resolution of this City Council, this City Council,
the legislative body of the City of Bakersfield, a chartered
city in the State of California, finds and determines by no less
vote than foUr-fifths of all of its members, that the public
convenience and n~ cessity require certain improvement work and
construction between Planz Road and Julian Avenue and on Julian
Avenue, the same being more'particularly described as follows,
to wit:
Construction and installation of durbs,
gutters and sidewalks, the construction
of a culvert and the pairing of streets
in the area described in E~hibits "A"
and "B" attached hereto.
That, therefore, under the provisions of the Constitution
and the Streets and Highways Code of the State of California,
the terms and provisions of the Special A~sessment Investigation,
Limitation and Majority Protest Act of l~31 shall not apply to
the doing of said improvement work and construction or any pro-
ceedings instigated or carried on in connection therewith.
I HEREBY CERTIFY that the foregoing resolutimwas duly
passed and'adopted by the City Council of the City of Bakersfield
on the 16th day of September, 196B, by the following vote:
AYES: BALFANZ, DOOLIN, MARCHBANKS, MOSSMAN, RUCKER, STIERN, WHITTEMORE
