A RESOLUTION DECLARING POLICY OF THE .CITY
COUNCIL OF THE CI'TY OF BAKERSFIELD ON 'THE
MATTER OF DEFENSE OF PUBLIC 0FEICERS AND
EMPLOYEES INVOLVED IN LITIGATION.
WHEREAS; the City-of Bakers-field, its officers and.
employees, from time to time, become. involved as party defendants
in civil litigation by reason of an act or o~ission.made in pursuit
of said office or employment, and .~. ....
'- WHEREAS, for reasons of law or sound public policy the
'City of Bakers field presently provides a defense Of its ·officers
and employees in such civil litigation where it appears. that the
said officer or employee has acted within the' .Scople of' his office
or 'employment and has not acted maliciously, and
WHEREAS, the' CalifOrnia 'Law Revision C0ff,~niSsion ' has
recoff~f, ended to the California State LegislatUre that defense in'
matters of this sort be provided to former 'employees as well ·as
present employees, and
WHEREAS, these recommendations are now incorporated into
legislation proposed to .the California ·Legis'latur~ by Senator
James Cobey in Senate. Bill No. ~5.
NOW, THEREFORE, BE IT RESOLVED by the 'Council'of the
City of Bakersfield that pending declaration and incorporation
into law by the California LegislatUre of a polic. y in this matter,
the City Council of the City of. Bakersfield hereby places itself
on record that in the event of .civil litigation in which an
.officer or employee or former officer or former employee of .the .'
City of Bakersfield is a' party defendant, .and where it is shown
that said person acted within the scope of his office or employment,'
without malice, the City of Bakersfield will provide the defense
for said officer or employee.

I'HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council.Of the City of· Bakersf'ield at a
regular meeting thereof held On the· 15th .day ~f April, 1963, by
