HomeMy WebLinkAboutRES NO 23-63RESOLUTION N0'.'/23-63 RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT PORTIONS OF CERTAIN TERRITORY DESIGNATED AS "SEARS NO. 1," AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO ·THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, proceedings.have been' commenced 'for the annexation of .certain unincorporated territory, designated as "Sears No. 1," to the City of Bakersfield, and 'WHEREAS, portions of said territory lie out:side' the Greater Bakersfield Separation Of Grade District, and WHEREAS, Section 8290 of the' Streets and Highways Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent' to the formation Of such district is annexed to or otherwise included wi. thin a city.which isa part of such district, shall immediately upon such annexation· to such city be included within the district·and shall thereafter become a part of the district to the Same extent as ·such city; except such portion or. portions thereof which the City Council has determined, will not be benefited by inclusion in the district. NOW, THEREFORE, BE IT RESOLVED by the Council .of the City· of Bakersfield, as follows: 1. That a description of the unincorporated· territory described in the annexation proceedings~ is as follows: Description of two parcels of land to be' annexed to the Greater Bakersfield Separation of Grade District, ·said parcels being portions of EXCEPTIONS in the "Organization of' the Greater Bakers- field Separation of Grade District" adopted by-.the Board of S~p~iS'O~" '6f; the ~'C~t~"8~"'K~r~h,~ ~St~te of '~ai'f~oi~iia'~"'~e~6~6~' June 29, 1954, in Book 98 at page· 153, of the Official Minutes; and said parcels being within the boundary of that annexation known as SEARS NO. 1. The parcels of land described more. particularly as follows: Parce 11: The easterly portion of the South one-half of the NOrtheast quarter of the Northeast quarter of Section 11, Township 30 South, Range 27 East, M.D.M. ,-being Exception No. 11 of the district. : Parce 12: · The northerly portion of the West 528 feet of the North 'on'e'half of-the Southwest quarter of the Northwest quarter of .SeCtion 12, Township 30 South, Range 27 East', M.D.M. ~ being Exception No. of the district. 2. That 'unless any portion shall be 'excluded by the City Council, all portions of said unincorporated territory shall upon annexation .to .the City of Bakersfield be included within.. the Greater Bakers field Separation of Grade. District. '3.
