HomeMy WebLinkAboutRES NO 35-62RESOLUTION NO~. 35-62 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE ACCESS WAY IN PUBLIC UTILITIES EASEMENT IN BLOCK 17 1, IN THE CITY OF BAKERSFIELD, CALIFORNIA. WHEREAS, on the 7th day of May, 1962, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Service Easements Vacation Law,!' being Sections 50430 to 50445, inclusive, of the Government Code of the State of California, passed.and adopted its Resolution of Intention No. 770, declaring 'its intention to order the vacation of the access way in a Public service easement, also referred'to herein aS a utility easement, in Block 171, situated in the City of Bakersfield, COunty of Kern, State of California, and WHEREAS, said Council did fix a' time and,place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 28th day of May, 1962, after notices were, duly published and.posted as required by law, and WHEREAS,' this Council after duly considering the matter, does hereby find and. resolve as follows: 1~ That said public service easement also referred to herein aS Utility Easement, hereinafter described, is unnecessary for present or prospective public use: Beginning at the intersection of the northerly boundary line of 22nd Street, of 82.5 feet in width~ with the westerly boundary line 'of "P" Street, of 82.5'in width, said point of beginning also being. the southeast corner of Block 171, situated in the City of Baker~field, County of Kern, State of California, and as said Block 171, and said Streets are shown on the "Map of the City of Bakersfield," filed in the Office of the County Recorder, of Kern County, Ca/l'ifornia, November 25, 1898, in Book 1 of Maps, at pages 13 .and 14; thence northerly along the westerly boundary line of sai. d-·'~Pt'-Street, to intersect a-line-~paral-le!lwi.th, and-dis-tant'~ 102.604 feet northerly, as measured perpendicular from the northerly boundary line of said 22nd Street, and to the true point of beginning;' thence westerly along last named parallel line, to intersect the easterly boundary line of "O" Street,. of 82.5 feet in width, and as said "0" Street is shown on said "Map of the City of Bakersfield"; thence northerly along the easterly boundary line of said "O" Street, to intersect a line parallel with, and distant 122'.604 feet northerly, as measured perpendicular from the northerly boundary line of said 22nd Street; thence easterly 'along last named. parallel line, to intersect the westerly 'boundary line of said "P" Street; thence southerly along the westerly boundary line of said "P" Street, to intersect the afore described line, which' line is parallel with, and distant 102.604 feet northerly, as measured perpendicular from the northerly boundary line of said 22nd Street, and to the true point of beginning,. containing 5280 square feet of land', more or less. 2.. That said public service easement be and the same is hereby vacated and abandoned for public service easement purposes, subject to and in conformity with said Resolution of Intention No. 770. Reference to said Resolution of Intention is hereby made for further, particulars. 3. The City Clerk shall certify to the passage Of this Resolution, and shall cause a certified, copy thereof, attested by the .Clerk under the seal of the City, to be recorded in the office of the County Recorder of Kern County, California -o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 28th day of May, 1962, by the following vote: :N_OES: ABSENT: ABSTAINING, · 1 of the C erk Council of the City of Bakers field.
