HomeMy WebLinkAboutRES NO 8-62 RESOLUTION NO. 8-62 A RESOLUTION OF T~E CITY COUNCIL OF THE CITY OF BAKERSFIELD FINDING' THAT THE PUBLIC INTEREST ,AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PARCELS OF LAND FOR THE REALIGNMENT OF 4TH STREET TO. CONNECT WITH PALM STREET 'AND "H" STREET IN THE CITY OF BAKERSFIELD AND DIRECTING THE CITY ATTORNEY T0 INSTITUTE EMINENT DOMAIN PROCEEDINGS. , BE IT RESOLVED that the City Council of the City of Bakersfield, State of .California, does hereby find and determine that the public interest and necessity require the acquisition of the fee simple title in and to the property hereinafter described for a public purpose, namely, for the improvement of the connection between 4th Street. and Palm Street in the vicinity of "H" Street, in the City of Bakersfield, and for such other public uses as may be authorized· by law; that the said property is necessary for such public use and purpose and that such public use is located in a manner which will be most compatible with the greatest public good and the least private inj!ury; and BE IT FURTHER RESOLVED that' the City Attorney of the said City of Bakersfield is hereby authorized and directed to institute eminent domain proceedings in the Superior Court of the State of California in and for the County of Kern for the purpose of acquiring the fee simple title in and to said following described property for said public purposes. That the said real property is situate in the City of Bakersfield, County of Kern, State of California, and is more particularly described as follows: Lots 1 - 2 - 3 and the south 6 feet of~Lot 4, Block 96 of Lowell Addition as shown in Map Book 1, Pages ......... 13" and 14 ~ -Records-of--Kern- C--ounty.~---Cati-fo-rnia-. ............................ The south 32' feet of Lot 12 and Lots 13 to 16 inclusive, of Block 96, Lowell Addition as s~own in Map Book 1, Pages 13 and 14, Records of Kern County, California. Including those portions of alley diminished under Resolution of Intention No. 347. BE IT FURTHER RESOLVED, 'that where, the public convenience and necessity require the taking of immediate possession, the said City Attorney of the City of Bakersfield is authorized to institute immediate possession .proceedings for the taking of immediate possession and use of the property herein ordered to be acquired upon complying with the requirements of the law applicable thereto, and the City Auditor is directed to draw warrants, payable to Vera K. Gibson, -County Clerk, and Ex-Officio Clerk of said Superior Court in the amounts fixed by said- Superior Court in its order directing deposit for said immediate possession. ...... -o0o- " I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield, at a regular meeting thereof held on the 13th day of February, .1~.6.2, by the following vote: AYES: NOES: ABSENT: ABSTAINING; Council of the City of ]Bakersfield.
