HomeMy WebLinkAboutRES NO 72-61RESOLUTION NO.. 7~-61 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, ORDERING THE VACATION OF AN ALLEY IN LOT 66, TRACT NO. 2438', IN SAID'CITY. WHEREAS, on the 19th day of June, 1961, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, part 3, (Sections 8300, et seq.) of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 761, declaring its intention to order the vacation of an alley situate within the City of Bakers- field, County of Kern, State of California, WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 10th day of July, 1961, after Notices were duly posted as required by law, and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That that alley situate in the City of Bakersfield, California, County of Kern, State of California described as follows, is unnecessary for present or prospective public street purposes: That 20-foot alley easement and alley cutoff in Lot 66, as shown in Tract No. 2438, recorded in Book 11 of Maps, pages 134, 135 and 136 in the office of the County Recorder of Kern County, however retaining that 5' public utilities easement as recorded on said Tract Map No. 2438. 2. That said alley be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with the reservation of the easement contained in and contemplated by said Resolution of Intention No. 761. Reference to 'said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 10th day of July, 1961, by the following vote: AYES.
