WHEREAS, the California Highway Commission has voted funds
~mder SeCtion 143.3 of the 'Streets and Highways Code to assist in
financing in the improvement of Union Avenue from Irene Street to
Panorama Drive, Urban Extension Project FAS 887, TJE-1,
AND WHEREAS, it is a requirement of the agreement between the
State of California, Department of Public Works and the City of
Bakersfield for the expenditure of said funds that the right of way
be certified clear before advertising a construction project,
NOW TEEORE BE IT RESOLVED, that the Mayor of the City of
Bakersfield'be, and he is'hereby authorized and directed tosign,
fop and on behalf of the City Council of the City of Bakersfield,
the Certificate relating to the right of way clearance on proposed
project on Union Avenue from Irene Street to Panorama Drive.

I _wR. REBY CERTIFY that the foregoing Resolution was passed and
adopted by the CounCil of the City of BakerSfield at a regular meeting
thereof held on the 10th day of July, 1961, by the following vote:

CERTIF'ICATE
The City of Bakersfield hereby certifies in connection with
t'he rights of way for proposed project on Union Avenue from Irene
Street to Panorama Drive, Urban Extension Project FAS 887UELl:
1. All necessary rights of way have been acquired.
2. All building improvements or utilities that
would interfere with construction have been
removed, or will be removed or relocated before
the contractor enters to perform construction.
3. A source for imported materials is available to
the contractor.
4- A disposal site for concrete removed and excess
excavation is available to the contractor.
In making this certification, the City agrees to hold the
State harmless from any liability which may be established in the
event the right of way is not clear as herein certified.
