HomeMy WebLinkAboutRES NO 70-61RESOLUTION NO. 70-61 RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF BAKERS- FIELD TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS "MONCURE NO. 1," AND GIVING NOTICE OF THE PRO- POSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD: That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Bakersfield, on its own motion, to annex to the City of Bakersfield all that uninhabited territory situate in the County of Kern, State of California, hereby designated as "Moncure No. 1" and described as follows: A parcel of land situate in the County of Kern, State of California, and being a portion of the East half of the Southeast quarter of Section 12, Township 30 South, Range 27 East, M.D.M: Beginning at the Southeast corner of Lot 1 of Tract No. 2385, and as said Lot 1 is shown on the Map of said Tract No. 2385 recorded April 1, 1960, in Book 11 of Maps at Page 66 in the office of the County Recorder of said Kern County; THENCE (1) North 0° 00' 30" W., along the Easterly boundary of said Lot 1 and along the Northerly prolongation thereof 812.53 feet, to the beginning of a tangent curve, from which the radial center of said curve bears South 89° 59' 30" W., distant 20 feet; THENCE. (2) Northwesterly along said curve, concave to the Southwest with a radius of 20 feet, through a central angle of 89° 54' 52", a distance of 31.386 feet to a point of tangency, from which the last named radial center bears South 0° 04' 38" W., distant 20 feet; THENCE (3) North 89° 55' 22" W., along a line parallel with, distant 45 feet Southerly from, and as measured perpendicular to the Northerly boundary of the Southeast quarter of said Section 12, a distance of 560.00 feet to the beginning of a tangent curve; THENCE (4) Southwesterly along said curve concave to the __~.~__~_~-._~..-_~--_--~SQu.t-~eas-t~-with a radius of 20 feet through a central angle of 90° 05' 08", a distance of 31.45 feet to a point distant 30 feet East of and as measured perpendi- cular to the West boundary of said Tract 2385, said last named boundary also being the Easterly boundary of that certain parcel of land conveyed to the County of Kern by Grant Deed dated February 24, 1960 and recorded April 12, 1960 in Book 3260 at Pages 659 and 660 Official Records of said Kern County; THF, NCF, (5) South 0° 00' 30" E. and parallel with last named East line a distance of 334.925 feet to a point in the Easterly extension of the South line of last named parcel so conveyed to the County of Kern; THENCF. (6) South 89° 59' 30" W., along last named Southerly boundary and Easterly extension thereof, a distance of 299.65 feet, more or less to intersect the Easterly boundary of the West 369.15 feet of the East half of the Southeast quarter of said Section 12; THENCE (7) North 0° 00' 52" W., along last named Easterly boundary a distance of 370.40 feet to intersect a line parallel with, distant 30 feet Southerly from, and as measured perpendicular to the Northerly boundary of the Southeast quarter of said Section 12, said last named intersection also being a point on the current corporate. boundary of the City of Bakersfield; THENCE (8) South 8.9° 55' 22" East, along last named parallel line, on and along said corporate boundary of the City of Bakersfield as said corporate boundary is defined by Ordinance No. 1021 New Series a distance of 924.69 feet, more or less, to intersect a line parallel with and distant 30 feet Westerly, as measured perpendicular from the Easterly boundary of the Southeast quarter of said Section 12; THENCE (9) South 0° 00' 30" E., along last named parallel line, on and along the corporate boundary of the City of Bakersfield as said corporate boundary is defined by Ordinance No. 898 New Series, a distance of 847.50 feet to intersect the Southerly boundary of said Tract No. 2385, said last named intersection also being the Southeast corner of said Tract No. 2385; THENCE (10) North 89° 55' 22" W., along last named Southerly boundary departing from the corporate boundary of the City of Bakersfield, a distance of 25 feet to the Southeast corner of Lot 1 in said Tract No. 2385, the point of beginning, containing 3.243 acres of land, more or less. 2. That the Council of the City of Bakersfield desires to annex said uninhabited territory to the City of Bakersfield for the following reasons: The territory is contiguous to the City of Bakersfield, and its proposed annexation will contribute to a~d facilitate the orderly growth and development of both the City. and the territory proposed to be annexed; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sani- tary and stormwater sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper overall planning and zoning of lands, and subdi- vision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of Kern County, Cali- fornia, did in session duly assembled on Tuesday, April 11, 1961, approve the proposed annexation boundaries of said "Moncure No. 1" as above described, and as submitted to said Corf~f~ission by the Council of the City of Bakersfield. 4. That Monday, August 21, ~961, at the hour of eight o'clock P.M., in the Council Chambers in the City Hall in the City of Bakers- field, County of Kern, California, is hereby fixed as the time and place when and where any person owning real property within the unin- habited territory above described and proposed to be annexed to the City of Bakersfield, and having any objections to the proposed annexation, may appear before the Council of the City of Bakersfield and show cause why such uninhabited territory. should not be so annexed to said City of Bakersfield. Such protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the description and area of such property, in general terms. 5. The 'City Clerk of the City of Bakersfield is hereby author- ized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in The Bakersfield Californian, a newspaper of general circulation published in said City of Bakersfield, the city to which it is proposed to annex the aforesaid territory, and also in Oildale News, a newspaper of general circu- lation published outside the City of Bakersfield, but in the County of Kern, California, the county in which is located the territory proposed to be annexed to the City of Bakersfield, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further' authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the county, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8.
