WHEREAS, the governing body of any i~corporated area within
the county may'petition the board of supervisors of any county Which
provides county funds for structural fire protection. in the county,
for exclusio~'bf. property within the incorporated areasj of said county
from the levy of taxes for such purpose, by resolution adopted by said
{governing body, finding that such incorporated city has an organized
fire department in operation and existence which is, at'such time,
providing .adequate structural fire protection to all property within
:such incorporated city, and that no additional benefit is received or
required by such property from structural fire protec'tion given by
· the county', and
WHEREAS, this Council finds'that the'City of. Bakersfield, a
municipal.Corporation, has an.organized.fire."department"in operation
and existence which is providing' adeqhate str'uctural.fire protection
to all property within said incorporated city, and that no additional
'benefit in fire protection is received or required byrSuch property
.from structural fire protection given by the..county. '
NOW, THERBFORB, BE IT RESOLVED that the City of'Bakersf. ield
'does hereby petition the Board of Supervisors of the County of Kern
/or the exclusion of'all property within the'corporate limits. of the
City of Bakersfield from the levy of taxes for structural fire 'pro-'
tection in'said incorporated area for the fiscal year 1961-1962, and
that the City Manager be.and he is hereby authorized and.directed
to .sign said petition and have the Same presented 'to the Board of
Supervisors of the County of Kern.
I H]~REBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular' meeting
thereof held on the 6th day of February, 1961, by the following vote:
