HomeMy WebLinkAboutRES NO 105-69RESOLUTION NO. 105-69 RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER .BAKERSFIELD SEPARATION OF GRADE DISTRICT CERTAIN TERRITORY DESIGNATED AS "PANORAMIC HEIGHTS NO. 3 -- PARCEL NO. 2", AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, 'proceedings have been commenced for the annexation of certain unincorporated territory, designated as "Panoramic Heights No 3 -- Parcel No 2" to the City of Bakersfield; and WHEREAS, all of said territory lies outside the Greater Bakersfield Separation of Grade District; and WHEREAS, Section 8290 of the Streets and Highways Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent to the formation of such district is annexed to or otherwise included within a city which is a part of such district, shall immediately upon such annexation to such city be included within the district and shall thereafter become a 'part of the district to the same extent as such city; except such portion or portions thereof which the City Council has determined, will not be benefited by inclusion in the district. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakers field, as follows: 1. That a description of the unincorporated territory described in the annexation 'proceedings, is as follows: Parcel No. 2: A parcel of land situate in the County of Kern, State of' California and being a 'portion of the NW 1/4 of Sectio. n 14, Township 29 South, Range 28 East, M.D.B. & M. Beginning at the southwest corner of the NW 1/4 of the NW 1/4 of said Section 14, being also a point on corporate boundary of the City of Bakersfield as defined by Ordinance No. 1099, New Series; Thence (1) northerly along the last named corporate boundary to intersect a line 'parallel with, and distant 360 feet-southerly from, as measured 'perpendicular to the northerly line of Section 15, Townshi'p 29 South, Range 28 East, M. D. B. & M., said intersection being also a point on the corporate boundary of the City of Bakersfield as defined by that certain resolution adopted January 2, 1957 by the Board of Supervisors of said Kern County, 'pertaining to that certain annexation designated as "Sanitary Landfill Area" and recorded in Book 113, Page 270, Official Minutes of said Board of Supervisors; Thence (2) S 71°42'45"E, along the last named corporate boundary, 1323.609 feet; Thence (3) departing from said corporate boundary, S 29°31'.53'~, 638.228 feet to intersect the south line of the NW 1/4 of the NW 1/4 of said Section 14, said intersection being also a point on the corporate boundary of the City of Bakersfield as defined by Ordinance No. 1354, New Series; Thence (4) westerly along the last named south line and corporate boundary to the point of beginning, containing 20.09 acres, more or less. 2. That unless any portion shall be excluded by the City Council, all Iportions of said unincorporated territory shall upon annexation to the City of Bakersfield be included within the Greater Bakersfield Separation of Grade District. 3. That Monday, the 19th day of January, 1970, at the hour of 8:00 P.M., in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, is the time when and the 'place where, objections to inclusion within the district will be heard.
