A RESOLUTION OF APPLICATION BY THE COUNCIL
OF THE CITY OF BAKERSFIELD DETACHING THOSE
PORTIONS OF RECENTLY ANNEXED TERRITORY
DESIGNATED AS SAN DIMAS NO. 2 AND SAN DIMAS
NO. 3 FROM THE ALTA VERDE SANITATION DISTRICT.
SECTION 1.:
WHEREAS,
a) By its Resolution No. 69-21 adopted on July 8, 1969
(Proceeding No. 217) and Resolution No. 69-20 adopted on June 24,
1969 (Proceeding No. 215) the KERN COUNTY LOCAL AGENCY FORMATION
COMMISSION approved the proposal for annexation to the City of
Bakersfield identified as San Dimas No. 2 and San Dimas No. 3 as
more particularly set forth in City of Bakersfield Ordinance No. 1819,
New Series, ad6'pted September 2, 1969, and Ordinance No. 1823, New
Series, adopted Se'ptember 15, 1969; and
b) By Ordinance No. 1819, New Series, which became
effective October 2, 1969, and Ordinance 1823, New Series, effective
October L5, 1969, said annexations were effected in the manner
'prescribed by law; and
c) By said resolutions of the Kern County Local Agency
Formation Commission more ~particularly identified in Paragraph (a)
hereinabove further 'provided that:
"upon completion of the annexation, 'proceedings
shall forthwith be commenced by the City of
Bakersfield for the detachment from the Alta
Verde County Sanitation District of the
territory annexed tO. the city~.''
d) This Council now pro'poseS to effect such detachment.
SECTION 2:'_ ~.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Council of
the City of Bakersfield as follows:
1. Pursuant to Section 56195 of the Government Code of
the State of California this Council hereby adopts its resolution
of aplplication and in accordance with Section 56140 of said Code
states as follows:
(i) This resolution is made pursuant to Division 1
(commencing with Section 56000) of Title 6 of said
Code.
(ii) The nature of the 'pro'posed change of organization
is: detachment; the name of the district for which
the change of organization is 'pro'posed is: Alta
Verde Sanitation District.
(iii) The names of all other affected counties, cities
or districts (in addition to the City of Bakersfield
and the Alta Verde Sanitation District) are:
a) Counties - County of Kern
b) Cities - None
c) Districts - None
(iv) The territory pro'posed to be detached is uninhabited,
the boundaries of such territory all within the
County of Kern, State of California are more
particularly described and delineated as follows:
Descri'ption of a 'parcel of land to be detached from the Alta Verde
Sanitation District.
A 'parcel of land situate in the County of Kern, State of California,
being a 'portion of Sections 18 and 19, Township 29 South, Range 28
East, M.D.B. & M. including all of Blocks 666, 667, 683, 684, 685
and 686, and a 'portion of Blocks 687, 696, 697, 698 and 700, as
said blocks are shown on a map entitled "Map of the City of Bakers-
field, Kern"~Eounty, California", recorded November 25, 1898 in the
office of the County Recorder of said County;
Beginning at the southwest corner of Block 631, as said Block 631
is shown on the aforementioned "Map of the City of Bakersfield"
Thence (1) westerly along the westerly extension of the south line
.of said Blo.ck__631_ to.the-southeast corner of Block 632, as said
BloCk 632 is shown on the aforementioned "Ma'p of the City of
Bakers field";
Thence (2) northerly along the east line of said Block 632 and along
the east line of Blocks 656, 665 and 687 and extensions thereof, to
the southeast corner of Lot 1, said Block 687;
Thence (3) westerly along the south line of said Lot 1 to the south-
west corner of said Lot 1;
Thence (4) southerly along the west line of said Block 687 and
Block 665 and extensions thereof to the northwest corner of Block
656, as said Blocks 665 and 656 are shown on the aforementioned
"Map of the City of Bakersfield";
Thence (5) westerly along the westerly extension of the north line
of said Block 656 and along the north line of Blocks 655 and 654
and extensions thereof to the northeast corner.of Block 653, as
said Blocks 655, 654, and 653 are shown on the aforementioned "Map
of the City of Bakersfield";
Thence (6) northerly along the northerly extension of the east line
of said Block 653 and along the east line of Blocks 669 and 668 and
extensions thereof to the northeast corner of said Block 668, as
said Blocks 669 and 668 are shown on the aforementioned "Map of
the City of Bakersfield".
Thence (7) westerly along the north line of said Block 668 to the
northwest corner of said Block 668;
Thence (8) northerly along the northerly extension of the west line
of said Block 668 and along the west line of said Blocks 683, 684
and 700 and extensions thereof to intersect the southerly right of
way line of the Kern River Levee, said right of way line being also
Course 3 of the Boundary descri'ption of the Alta Verde Sanitation
District as defined by that certain resolution adopted July 28, 1947,
by the Board of Supervisors of said Kern County, and recorded in
Book'64, Page 74, Official Minutes of said Board of Supervisors;
Thence (9) northeasterly along said southerly right of way line to
intersect the north line of said Block 698;
Thence (10).easterly along the last named north line and easterly
extension thereof to intersect the centerline of "L" Street, of
82.5 feet in width, as said "L" Street is shown on the aforementioned
"Ma'p of the City of Bakersfield'~';
Thence (11) S 0°05'00"W along the last named centerline to intersect
the westerly extension of the south line of Lot 2, said Block 697;
Thence (12) N 89°58'08"E, along the last named westerly extension
and south line of said Lot 2, 41.47 feet;
Thence (13) N 64°11'30"E, to intersect the north line of said Block
696;
Thence (14) easterly along the last named north line and easterly
extension thereof to the northwest corner of Block 695, as said
Block 695 is shown on the aforementioned "Map of the City of
Bakersfield";
Thence (15) southerly along the west line of said Block 695 and
B~ocks.688, 664,. 657 and 631 and extensions thereof--to--the 'point
of beginning.
(v) The 'proposed terms and conditions to which the
'pro'posed change of organization is desired to be
subject is: None.
(Vi) The reason for the 'proposal is: The territory
contained within the San Dimas No. 2 and San Dimas
No. 3 annexations to the City of Bakersfield will
now receive from said City as a munici'pal function
thereof all of the services and functions now being
~provided to said territory by the Alta Verde
Sanitation District; the detachment of said
territory from the said district will therefore
relieve said territory from taxation by both the
Alta Verde Sanitation District and the City of
Bakersfield.
2. It is contemplated that satisfactory 'proof will be
submitted to the Kern County Local Agency Formation Commission that
all of the owners of the land within the territory 'pro'posed for
detachment have given their written consent thereto and all as
more 'particularly authorized by Section 56261 of said Code.
3. In accord with all the foregoing request is hereby
made:
(i) That proceedings be taken for change of organization
'pro'posed herein, to wit: detachment of San Dimas
No. 1 and San Dimas No. 3 from the Alta Verde
Sanitation District;
(ii) That upon filing of the satisfactory'proof of
consent hereinabove more particularly referred to
in 'paragraph 2 and in accord with the 'provisions of
Section 56261 of said Code the Kern County Local
Agency Formation Commission (a) approves such
detachment without notice and hearing by the
COmmission and (b) authorizes the Board of
Directors of the Alta Verde Sanitation District
to detach said territory without notice and
hearing by said board and without an election.
4. The secretary of this Council shall transmit
forthwith eleven (11) certified copies of this resolution to the
Mayor of the City of Bakersfield.
5. The Mayor of the City of Bakersfield shall forthwith
execute and file with said commission its form KCLAFC #7-NS
'pursuant to the regulations of the commission.

I HEREBY CERTIFY that the foregoing Resolution was

regular meeting thereof held on the 3rd day of November, 1969, by
