HomeMy WebLinkAboutRES NO 77-69RESOLUTION NO. 77-69 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PORTION OF 30TH STREET BETWEEN THE S.P.R.R. AND JEWETT AVENUE AND A PORTION OF ESPEE STREET BETWEEN JEWETT AVENUE AND 30TH STREET IN THE CITY OF BAKERSFIELD. WHEREAS, on the 7th day of July, 1969, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941", being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 841, declaring its intention to order the vacation of a portion of 30th Street between the S.P.R.R. and Jewett Avenue and a portion of Espee Street between Jewett Avenue and 30th Street, City of Bakersfield, California, and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 4th day of August, 1969, after notices were duly posted as required by law, and WHEREAS, this Council after duly considering the matter, does hereby find and. resolve as follows: 1. That that portion of 30th Street between the S.P.R.R. and Jewett Avenue and that portion of Espee Street between Jewett Avenue and 30th Street situate in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, are unnecessary for present or prospective public street purposes: PARCEL A Being that portion of 30th Street between the Southern Pacific Rail- road Right of Way and Jewett Avenue as shown on the Map of Northern Division of the Town of Bakersfield filed in the office of the County Recorder of Kern County on April 26, 1889 described as follows: Beginning at the southeast corner of Lot 1 of Block 580 of the above mentioned Map, said corner being also the intersection of th~ north right of way line of 30th Street with the west right of way line of Jewett Avenue as shown on said Map; Thence (1) along the southerly prolongation of the west line of Jewett Avenue South 36.52 feet to the beginning of a tangent curve; Thence (2) curving to the west with a radius of 20 feet thru an arc of 108°33'11'' for a distance of 37.89 feet to a point of compound curve; Thence (3) westerly along a curve concave to the north with a radius of 528.75 feet thru an arc of 2o30'00'' for a distance of 23.07 feet t6 a point of reverse curve; Thence (4) westerly along a curve concave to the south with a radius of 595.25 feet to the intersection of said curve with the south- easterly prolongation of the northeasterly right of way line of the Southern Pacific Railroad right of way; Thence (5) northwesterly along said prolongation of said railroad right of way line to intersect the westerly prolongation of the northerly right of way line of 30th Street; Thence (6) easterly along last said prolongation and northerly right of way line of 30th Street to the point of beginning. Excepting the southerly 10 feet of the northerly 25 feet of the above described parcel to be reserved as a public utilities easement. PARCEL B Being that portion of Espee Street between Jewett Avenue and 30th Street as shown on the map of Homaker Park filed in the office of the County Recorder of Kern County on April 1, 1915 described as follows; Commencing at a point in the centerline of 30th Street distant thereon 100.62 feet east from the intersection of said centerline with the southerly prolongation of the centerline of Jewerr Avenue, and from which point the monument marking the intersection of the centerlines of the 20 foot wide alley between Lots 13 and 14 of Block 9 of said Homaker Park and said 30th Street lies easterly 117.5 feet, more or less; Thence from said point of commencement, north, at right angles to said centerline of 30th Street, 33.25 feet to the true point of beginning, said point of beginning being also the point of tangency of a 528.75 foot radius curve concave to the north with a line parallel with said centerline of 30th Street and 33.25 feet northerly, measured at right angles to said centerline; Thence (1) westerly along said curve thru an arc of 4°26'10'' for a distance of 40.94 feet to a point of compound curve; Thence (2) curving to the north along a curve with a radius of 20 feet thru an arc of 85033'35'' for a distance of 29.87 feet to a point of tangency in the Southerly prolongation of the easterly right of way line of Jewett Avenue; T-hence (3) northerly-along said southerly prolongation to-the '- intersection of the easterly right of way line of Jewett Avenue with the northeasterly right of way line of Espee Street; Thence (4) Southeasterly along said northeasterly line of Espee Street to a point in a line parallel with the centerline of BOth Street and 33.25 feet northerly, measured at right angles to said centerline. Thence (5) westerly along said parallel line to the true point of beginning. Excepting a 10 foot wide strip crossing the entire Parcel B and lying southwesterly from and contiguous to a line which is parallel with and 15 feet southwesterly, measured at right angles from the northeasterly right of way line of Espee Street (Course (4)) to be reserved as a public utilities easement. 2. That said portion of 30th Street between the S.P.R.R. and Jewett Avenue and said portion of Espee Street between Jewett Avenue and 30th Street be and the same are hereby closed up, vacated and abandoned for public street purposes subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 841. Rererence to said Resolution of Intention is hereby made for further particulars. 3.
