A RESOLUTION OF APPLICATION BY. THE COUNCIL OF THE
CITY OF BAKERSFIELD DETACHING THAT PORTION OF
RECENTLY ANNEXED TERRITORY DESIGNATED AS MOUNT
VERNON NO. 2 FROM THE PANORAMA SANITATION DISTRICT.
SECTION 1:
WHEREAS,
a) By its Resolution No. 69-26 adopted on January 14,
1969 (Proceeding No. 190) the KERN COUNTY LOCAL AGENCY FORMATION
COMMISSION approved the proposal for annexation to the City of
Bakersfield identified as Mount Vernon No. 2 as more particularly
set forth in City of Bakersfield Ordinance No. 1779 New Series which
was adopted March 10, 1969, and
b) By Ordinance No. 1779 New Series which became
effective April 14, 1969, said annexation was effected in the manner
prescribed by law, and
c) By said resolution of the Kern County Local Agency
Formation Commission more particularly identified in Paragraph (a)
hereinabove further provided that:
"Upon Completion of the annexation proceedings
shall forthwith be commenced by the City of
Bakersfield for the detachment from the Panorama
Sanitation District of the territory annexed to
the City".

This Council now proposes to effect such
SECTION 2:
NOW, THEREFORE, IT IS HEREBY RESOLVED by th~ Council of
the City of Bakersfield as follows:
1. Pursuant to Section 56195 of the Government Code of
the State of California this Council hereby adopts its resolution
of application and in accordance with Section 56140 of said Code
states as follows:
(i) This resolution is made pursuant to Division 1
(commencing with Section 56000) of Title 6 of said
Code.
(ii) The nature of the proposed change of organization
is: detachment; the name of the district for which
the change of organization is proposed is: Panorama
County Sanitation District.
(iii) The names of all other affected counties, cities
or districts (in addition to the City of Bakersfield
and the Panorama Sanitation District) are:
a) Counties - County of Kern
b) Cities - None
c) Districts - None
(iv) The territory proposed to be detached is uninhabited,
the boundaries of such territory all within the
County of Kern, State of California are more
particularly described and delineated as follows:
Description of a parcel of land to be detached from the Panorama
Sanitation District.
A parcel of land situate in the County of Kern, State of California
and being a portion of Section 21, Township 29 South, Range 28 East,
M.D.B. & M. and more particularly described as follows:
Beginning at the intersection of the North line of said Section 21
with the Northerly prolongation of the East line of Lot 1, Tract
No. 1282, as said Tract is shown on a map recorded July 25, 1946
in Book 5 of Maps at page 156, Records of said Kern County;
Thence (1) Easterly along the lastsnamed-north line to the
northeast corner of said Section 21;
Thence (2) Southerly along the east line of said Section 21 to
intersect the Easterly extension of the North line of Tract
No. 1629, as said tract is ~hown on a map recorded July 16,
'1952 in Book 8 of Maps, Page 23, records of said Kern County;
Thence (3) Westerly, along the last named North line and Easterly
extension thereof to intersect the centerline of Floral Drive
as said centerline is shown on a map of said Tract No. 1629,
said intersection also being the Southeast corner of Tract
No. 1713, as said Tract is shown on a map recorded July 2, 1954
in Book 8 of Maps, page 135, records of said Kern County~;
Thence (4) N 0°15'47"E along the East line and Northerly extention
thereof of said Tract No. 1713 to intersect the Southerly right
of way line of State Highway Rte 178 (VI-Ker-178), said inter-
.section being 81.20 feet Northerly, as measured along the East
line and Northerly extension of the East line of said Tract
No. 1713 from the Northeast corner of Lot 29, said Tract No. 1713;
Thence (5) along said Southerly right of way line the following
10 courses: S 71°29'31"'W, 351.97 feet;
Thence (6) S 72°07'43'~, 100.00 feet;
Thence (7) S 74°59'28'~, 100.13 feet;
Thence (8) N 88°13'03'~, 29.73 feet;
Thence (9) S 72°07'43'~, 272.00 feet;
Thence (10) S 71°33'20'~, 500.03 feet;
Thence (11) S 69°04'33'~, 375.53 feet;
Thence (12) S 20°55'27"E, 105.04 feet to the beginning of a
tangent curve;
Thence (13) Southerly along said curve, concave to the Northwest
with a radius of 200 feet, through an angle of 111°12'14'' an
arc distance of 388.17 feet to a point of tangency;
Thence (14) N 89°43'13'~ along said Southerly right of way and
extension thereof to intersect the West right of way line of
Haley Street, said West right of way line also being the West
line of the East 15 feet of Lot 12, Mesa Tract No. 2, as said
Mesa Tract No. 2 is shown on a map recorded February 13, 1914
in Book 3, Page 4 of Maps, Records of said Kern County;
Thence (15) Northerly along the last named West line and extension
thereof and the West line and extension thereof of the East
15 feet of Block 3, Wilshire Heights No. 3 addition, as said
Wilshire Heights No. 3 is shown on a map recorded May 4, 1911
in Book 2, Page 25 of Maps, Records of said Kern County and
the West line of the East 15 feet of Villa Lot 12 of Drury's
Addition to Kern City, as per map recorded March 18, 1907 in
Book 1, Page 101 of Maps, records of said Kern County, to
intersect the North line of the South 465.17 feet of said
Villa Lot 12;
Thence (16) Easterly along the last named. Nor_th line~ to. intersect
the West right of way line of Haley Street, formerly Hay Street,
as said Hay Street is shown on a map of Tract No. 1282, filed
for record July 25, 1946 in Book 5, Page 156 of Maps, records
of said Kern County;
Thence (17) Northerly along the last named West right of way line
and extensions thereof to the point of beginning.

The proposed terms and conditions to which the proposed
change of organization is desired to be subject is: None.
The reason for the proposal is: The territory contained
within the Mount Vernon No. 2 annexation to the City of
Bakersfield will now receive from said City as a municipal
function thereof all of the services and functions now
being provided to said territory by the Panorama County
Sanitation District; the detachment of said territory
from the said district will therefore relieve said
territory from taxation by both the Panorama County
Sanitation District and the City of Bakersfield.
2. It is contemplated that satisfactory proof will be
submitted to the Kern County Local Agency Formation Commission that
all of the owners of the land within the territory proposed for
detachment have given their written consent thereto and all as
more particularly authorized by Section 56261 of said Code.
3. In accord with all the foregoing request is hereby
made:
That proceedings be taken for change of organization
proposed herein, to wit: detachment of Mount Vernon
No. 2 from the Panorama County Sanitation District;
That upon filing of the satisfactory proof of
consent hereinabove more particularly referred to
in paragraph 2 and in accord with the provisions of
Section 56261 of said Code the Kern County Local
Agency Formation Commission (a) approve such detach-
ment without notice and hearing by the Commission
and (b) authorize the Board of Directors of the
Panorama Sanitation District to detach said
territory without notice and hearing by said board
and without an election.
4. The secretary of this Council shall transmit
forthwith eleven (11) certified copies of this resolution to the
Mayor of the City of Bakersfield.
5. The Mayor of the City of Bakersfield shall forthwith
execute and file with said commission its form KCLAFC #7-NS
pursuant to the regulations of the commission.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 4th day of August, 1969, by
