HomeMy WebLinkAboutRES NO 74-69RESOLUTION NO. 74-69 A RESOLUTION DETERMINING AND DECLARING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY OF THE CITY OF BAKERS- FIELD REQUIRE THE WIDENING OF BRUNDAGE LANE BETWEEN LAKEVIEW AVENUE AND KING STREET WMICH INCLUDES THE SOUTH 15 FEET OF A PORTION OF BLOCK 30 AS SAID BLOCK IS SHOWN ON THE MAP OF MAYFLOWER ADDITION RECORDED JULY 6, 1911 IN BOOK 2, PAGE 29 OF MAPS IN THE OFFICE OF THE COUNTY RECORDER OF THE COUNTY OF KERN, STATE OF CALIFORNIA AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISITION OF CERTAIN REAL PROPERTY TO BE USED BY THE CITY FOR THE STREET WIDENING CONSTRUCTION IN THE AFOREDESCRIBED AREA; AND DECLARING THE INTENTION OF THE CITY OF BAKERS- FIELD TO ACQUIRE SAID PROPERTY UNDER EMINENT DOMAIN PROCEEDINGS AND DIRECTING THE CITY ATTORNEY OF THE CITY OF BAKERSFIELD TO COMMENCE AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA, IN AND FOR THE COUNTY OF KERN FOR THE PURPOSE OF ACQUIRING SAID REAL PROPERTY. WHEREAS, the City Council of the City of Bakersfield, after holding a hearing on the proposed plan lines for widening Brundage Lane, which plan lines were recommended by the Planning Commission of the City of Bakersfield in a regular full session on September 11, 1967 approved the plan lines for the widening of Brundage Lane between Lakeview Avenue and King Street; and WHEREAS, said approval requires the acquisition of lands, easements and other property necessary for this municipal improve- ment; and WHEREAS, it is necessary that the properties designated, on the plans be acquired in order to proceed with the proposed improvement. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. The public interest, convenience and necessity of the City of Bakersfield and the inhabitants thereof require the widening of Brundage Lane between Lakeview Avenue and King Street. 2. The public interest, convenience and necessity of said city and the inhabitants thereof demand the acquisition and taking of the hereinafter described real property for the afore- mentioned street widening. 3. The property to be condemned is the south 15 feet of a portion of Block 30 as said block is shown on the Map of Mayflower Addition recorded July 6, 1911 in Book 2, page 29 of Maps in the office of the County Recorder of the County of Kern, State of California. 4. The taking and acquiring by said City of the property hereinbefore described is deemed necessary for the widening of Brundage Lane between Lakeview Avenue and King Street by the City of Bakersfield and the inhabitants thereof for a municipal purpose; such use is a public use, and that for such public use it is necessary that the City of Bakersfield condemn and acquire said property for aforementioned street widening. 5. The City Attorney of the City of Bakersfield be and he is hereby authorized and directed to commence an action in the Superior Court of the State of California in and for the County of Kern, in the name and on behalf of the City of Bakersfield against all owners and claimants of the above-described property, for the purpose of condemning and acquiring said property for the use of said city. o0o- I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 4th day of August, 1969, by the following vote: AYES: COUNCILMEN BLEECKER, HEISEY, REES, ~, STIERN, VETTER, WHITrEMORE CITY CLERK a~ Ex O~fic~'of the Council of the City of Bakersfield ~PPROVED this 4th~d, ay of August, 1969 APPROVED: By Kenneth W.
