HomeMy WebLinkAboutRES NO 73-69RESOLUTION NO. 73-69 A RESOLUTION OF THE CITY OF BAKERSFIELD ENDORSING THE REPORT OF THE EXECUTIVE OFFICER IN PROCEEDING NO. 216 BEFORE THE LOCAL AGENCY FORMATION COMMISSION AND URGING IMPLEMENTATION OF THE RECOMMENDATION CONTAINED THEREIN. WHEREAS, in a proceeding before the Local Agency Formation Commission relative to an annexation to an existing County Sanitation District whose boundaries were contiguous to an incorporated city, the Executive Officer of LAFCO made certain observations and recommendations in his report to the Commission, and WHEREAS, the report pointed out that there are no less than seven of these County Sanitation Districts presided over by the Board of Supervisors who receive compensation for the meetings in addition to their annual salary, and WHEREAS, funds out of the county general fund are being used on behalf of these special districts such as the $2,500.00 fee paid Hiller and Weise Engineering Company for an engineering feasibility report for an area of land which sought annexation to the Union Avenue Sanitation District wherein this particular area represented only .01% of land area of the county, .56% of county population and .08% of assessed valuation. WHEREAS, four of these sanitation districts are not self-sufficient in that they must rely on city disposal plants to dispose of their sewage, and WHEREAS, as long as the Board of Supervisors receive additional compensation for these districts they have been unwilling to see that they are annexed, merged, consolidated or changed in any way to provide more economical and efficient operation, and WHEREAS, the Executive Officer of LAFCO has undertaken to recommend that these districts be changed to County Service Areas thereby eliminating the unnecessary expense of administering these districts, and WHEREAS, the Executive Officer's recommendation~is that LAFCO recommend to the Board of Supervisors that the supervisors forthwith institute proceedings for the formation of County Service Areas and the transfer of the district function to the county under the County Service Law to be administered by the County Government and taxes levied in the particular service area for such operations of the area as is done in other county service areas, thereby eliminating use of general county funds for special districts. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD AS FOLLOWS: 1. This City supports the recommendation of the Executive Officer of the Local Agency Formation Commission relative to county sanitation districts contained in his report to the Commission in pro- ceeding No. 216. 2. That this Resolution be presented to the Board of Supervisors of the County of Kern and to the Local Agency Formation Commission. 3. That the supplemental recommendations contained in the report of ~he Executive Officer in Pro- ceeding No. 216 be acted upon without delay by both LAFCO and the Board of Supervisors.
