RESOLUTION MAKING FINDINGS AND DETERMINATIONS
ON A PETITION FOR THE CONSTRUCTION OF CURBS,
GUTTERS, SIDEWALKS, DRIVEWAY APPROACHES AND
NECESSARY PAVEMENT REPLACEMENT ADJACENT TO
LOT i THROUGH 87 ALL IN TRACT NO. 1238 IN
THE VICINITY OF GORRILL STREET, POTOMAC
AVENUE AND ROBINSON STREET IN THE CITY OF
BAKERSFIELD, CALIFORNIA AS SAID LOCATION IS
MORE FULLY DESCRIBED IN ATTACHED "EXHIBIT A"
AND SHOWN ON ATTACHED "EXHIBIT B" .
WHEREAS, in accordance with the provisions of Section
2804 of the California Streets and Highways Code all of the owners
of more than sixty percent (60%) in area of all of the properties
subject to assessment in the proposed district for the improvements
hereinafter described have signed and filed with the City of
Bakersfield a written petition requesting the construction of
curbs, gutters, sidewalks, driveway approaches and necessary pave-
ment replacement within the proposed Public Improvement District
No. 839 by proceedings to be taken by the City Council pursuant
to the Improvement Act of 1911, and further requesting the
issuance of bonds to pay the unpaid assessments resulting there-
from, and by said petition, waived all proceedings required by the
provisions of Division IV of said Streets and Highways Code,
(being The Special Assessment Investigation, Limitation and
Majority Protest Act of 1931, Streets and Highways Code, Sections
2800 to 3012); and
WHEREAS, said City Council desires in accordance with
said request to initiate proceedings under the Improvement Act of
1911, (commencing with Section 5000, Streets and Highways Code)
for the construction of said improvements; and
WHEREAS, it is believed that the public interest,
convenience and necessity require the construction of said
improvements.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that:
1. ]he foregoing recitals are true and correct and
the City Council so finds and determines.
2. The City Council finds that said petitions filed
with the City Clerk of the City of Bakersfield, who is the
Ex-Officio Clerk of the City Council of said City, the legislative
body undertaking said proceedings, have been signed by the owners
of more than sixty percent (607°) in area of all of the property
subject to assessment for the cost of the proposed improvement
work hereinafter described; and hereby grants said petition
requesting said work and determines that the investigation and
other requirements provided by the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931 have been waived in
connection with said improvement work by virtue of Clause Three
(3) of Section 2804 of the Streets and Highways Code.
3. Said improvement work and construction to be in the
City of Bakersfield described as follows:
The construction of curbs, gutters, sidewalks,
driveway approaches, and necessary pavement
replacement adjacent to Lots 1 through 87 all
in Tract No. 1238 in the vicinity of Gorrill
Street, Potomac Avenue and Robinson Street in
the City of Bakersfield, California.
4. All of said work to be done within the improvement
district shown on the map attached and marked "Exhibit B" and
described in the boundary description marked "Exhibit A" .

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at
a regular meeting thereof held on the 16th day of June, 1969,
by the following vote:

PUBLIC IMPROVEMENT DISTRICT NO. 839
Beginning at the intersection of the centerline of Potomac Street and the
centerline of Owens Street as said Streets are shown on Tract No. 1232, filed
for record May 11, 1944 in Book 5 of Maps, Page 76, Records of Kern County,
State of California;
Thence (1) easterly along the centerline of said Potomac Street to intersect
the centerline of Lakeview Avenue (formerly Cottonwood Road) said
Cottonwood Road being as shown on said Tract No. 1232;
Thence (2) southerly along the centerline of said Cottonwood Road to intersect
the easterly extension of the south line of Lot 59, said Tract No. 1232;
Thence (3) westerly along the last named easterly extension and westerly along
the south line of Lots 59 through 87 and extensions thereof' to intersect
the centerline of Owens Street, said street and lots being as shown on said
Tract No. 1232;
Thence (.4) northerly along the centerline of said Owens Street to the point of
beginning for this description.
