HomeMy WebLinkAboutRES NO 46-69RESOLUTION NO. 46-69 RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT CERTAIN TERRITORY DESIGNATED AS "PANORAMIC HEIGHTS NO. 2", AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, proceedings have been commenced for the annexation of certain unincorporated territory, designated as "'~ano~mic Heights No. 2", to the City of Bakersfield, and WHEREAS, all of said territory lies outside the Greater Bakersfield Separation of Grade District, and WHEREAS, Section 8290 of the Streets and Highways Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent to the formation of such district is annexed to or otherwise included within a city which is a part of such district, shall immediately upon such annexation to such city be included within the district and shall thereafter become a part of the district to the same extent as such city; except such portion or portions thereof which the City Council has 'determined, will not be benefited by inclusion in the district. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. That a description of the unincorporated territory described in the annexation proceedings, is as follows: A parcel of land situate in the County of Kern, State of California and being a portion of Section 10, Township 29 South, Range 28 East, M.D.B. & M. and more particularly described as follows: Beginning at the intersection of the North line of the South 55 feet of said Section 10 with the West line of the SE 1/4 of said Section 10, said intersection also being a point on the Corporate Boundary'of the City of Bakersfield as defined by Ordinance No. 1390, New Series; Thence (1) Easterly along Course 33 of the last named corporate boundary to intersect the East line of the SW 1/4 of the SE 1/4 of said Section 10, said intersection also being a point on the corporate boundary of the City of Bakersfield as defined by that certain resolution adopted January 2, 1957, by the Board of Supervisors of said Kern CoUnty, pertaining to that certain annexation designated as "Sanitary Landfill Area" and recorded in Book 113, Page 270, Official Minutes of said Board of Supervisors; Thence (2) Northerly along the last named corporate boundary to intersect the North line of the S 1/2 of the SE 1/4 of said Section 10; Thence (3) Westerly, departing from said corporate boundary, along the last named North line to intersect the West line of the East 550 feet of the SW 1/4 of the SE 1/4 of said Section 10; Thence (4) Southerly along the last named West line a distance of 400 feet; Thence (5) Southeasterly, and in a direct line to a point which is the intersection of the North line of the South 245 feet of said Section 10 with the West line of the East 150 feet of the SW 1/4 of the SE 1/4 of said Section 10; Thence (6) Westerly along the last named North line to intersect the West line of the East 300 feet of the SW 1/4 of the SE 1/4 of said Section 10; Thence (2) Southerly along the last named West line to intersect the North line of the South 180 feet of said Section 10; Thence (8) Westerly along the last named North line to intersect the West line of the SE 1/4 of said Section 10, said intersection also being a point on the corporate boundary of the City of Bakersfield as defined by said Ordinance No. 1390, New Series; Thence (9) Southerly along the last named corporate boundary to the point of beginning and containing 14.9 acres more or less. 2. That unless any portion shall be excluded by the City Council, all portions of said unincorporated territory shall upon annexation to the City of Bakersfield be included within the Greater Bakersfield Separation of Grade District. 3. That Monday, the 16th day of June, 1969, at the hour of 8:00 P.M., in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfields California, is the ~imewhen add the place where, objections to inclusion within the district will be heard. o0o 2.
