HomeMy WebLinkAboutRES NO 02-69RESOLUTION NO..2-69 RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT CERTAIN TERRITORY DESIGNATED AS "STOCKDALE NO. 1", AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, proceedings have been commenced for the annexation of certain unincorporated territory, designated as "Stockdale No. 1", to the City of Bakersfield, and WHEREAS, all of said territory lies outside the Greater Bakersfield Separation of Grade District, and WHEREAS, Section 8290 of the Streets and Highways' Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent to the formation of such district is annexed to or otherwise included within a city which is a part of such district, shall immediately upon such annexation to such city be included within the district and shall thereafter become a part of the district to the same extent as such city; except such portion or portions thereof which the City Council has determined, will not be benefited by inclusion in the district. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. That a description of the unincorporated territory described in the annexation proceedings, is as follows: A parcel of land situate in the County of Kern, State of California, and being a portion of Sections 33, 34 and 35, Township 29 South, Range 27 East, M.D.B. & M. and Section 4, Township 30 South, Range 27 Eas~ M.D.B. & M., and more particularly described as follows: Beginning at the Northeast corner of that certain parcel of land designated as Parcel 2 in a deed recorded June 12, 1928 in Book 246, Page 382, Official Records of said Kern County, said North- east corner also being a point shown as Corner No. 21 on the Record of Survey Map of Stockdale Golf and Country Club, recorded August 20, 1940 in Record of Survey Map Book 4, Page 135; Thence (1) Westerly along the Northerly boundary of the last named parcel of land to intersect the West line of the E~ of the W~a of said Section 4; Thence (2) Northerly along th~last named West line and the West line of the E~ of the of said Section 33 to intersect the South line of the North 1600 feet of said Section 33; Thence (3) Easterly along the last named South line to intersect the East line of said Section 33; Thence (4) Northeasterly and in a direct line to a point on the North line of said Section 34, said point being distant thereon 2000 feet West of the Northeast corner of said Section 34; Thence (5) Easterly along the last named North line and the North line of said Section 35 to intersect the Southeasterly bank of the Gates Canal, said Southeasterly bank being also a point on the Corporate Boundary of the City of Bakersfield, as defined by Ordinance No. 1748, New Series; Thence (6) Southwesterly and Southerly along the last named Corporate Boundary to intersect the South line of the N~ of the NE~ of said Section 34; Thence (7) Westerly, departing from said Corporate Boundary, along the last named South line a distance of 1400 feet; Thence (8) Southwesterly and in a direct line to a point on the West line of the NE~ of said Section 34, said point being distant thereon 1040 feet North of the Southwest corner of the NE~ of said Section 34; Thence (9) Southwesterly and in a direct line to a point on the South line of the NW~ of said Section 34, said point being distant thereon 460 feet East of the Southwest corner of the NW~ of said Section 34; Thence (10) Westerly along the last named South line and the South line. of the N~ of said Section 33 to intersect the Northerly extension of West line of Lots 106 through 126, Tract No. 2548 as said Tract is shown on a map recorded August 17, 1961 in Map Book 12, pages 57'and 58, Records of said Kern County; Thence (11) S 0°-56'44'' W along the last named Northerly extension and the West line of said lots to a point on West line of said Lot 106 which lies 1753.35 feet South of the Northwest corner of said Tract No. 2548; Thence (12) S 27°30'07"W to the southwest corner of said Tract No. 2648; Thenc~(~3) S.62°29'53"E along the SoUtherly Boundary Line,.of said"Tra~t No. 2~4~, to' intersect the WeSterly~ine of the~ Buena Vista Canal Reservation, of 150 feet in width, as said canal reservation is shown on the aforementioned Record of Survey Map of Stockdale Golf and Country Club; Thence (14) S 27°30'07'~ to a point designated as (Sta. 7) on said Record of Survey Map; Thence (15) S 0°09'07"W to the point of beginning and containing 409 acres more or less. 2. That unless any portion shall be excluded by the City Council, all portions of said unincorporated territory shall upon annexation to the City of Bakersfield be included within the Greater Bakersfield Separation of Grade District. 3. That Monday, the 17th day of February, 1969, at the hour of 8:00 P.M., in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, is the time when and the place where, objections to inclusion' within the district will be heard.
