HomeMy WebLinkAboutRES NO 97-68RESOLUTION NO. 97-68 A RESOLUTION OF THE CITY OF BAKERSFIELD, CALIFORNIA MAKING FINDINGS AND OVERRULING PROTESTS AND OBJECTIONS AND ORDERING THE FORMATION OF A BUSINESS PROMOTION DISTRICT IN THAT PORTION OF DOWNTOWN BAKERSFIELD DESCRIBED HEREIN IN SAID RESOLUTION;· DETERMINING THAT ADDITIONAL TAX SHOULD BE · IMPOSED UPON THOSE BUSINESSES IN SAID BUSINESS ·DISTRICT; DETERMINING' THE USES TO WHICH THE ADDITIONAL .REVENUE DERIVED FROM THE ADDITIONAL TAX SHALL BE PUT AND DETER- MINING THE EXTENT OF TAXES TO BE LEVIED TO SUPPORT' SAID DISTRICT AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE FORMATION OF SAID DISTRICT. WHEREAS, this City Council duly adopted its resolution of intention, Resolution No. 65-68, on AuguSt 5, 1968 declaring its intention to establish a business promotion district in that portion of downtown Bakersfield described in the resolution, determining that additional tax shall be imposed upon those businesses in said -promotion business district; determining the uses to which the additional revenue derived from the additional tax shall be put and fixing the time and place for hearing protests·and objections to the formation of the district, the boundaries, or the extent of taxes to be levied to support said district, or all, and whether public convenience and necessity require the formation of such a 'district; and, WHEREAS, said resolution of intention was' duly published and posted, and notice of passage thereof mailed, as ~provided by Ordinance No. 17'41, New Series, of the City of Bakersfield, and said hearing was duly held at the time and place so fixed, and all continuances were duly made, ordered, and held; and '~ WHEREAS, at said hearings all persons desiring· to be \ heard were fully heard, and all oral and written protests and Obj e~'Ci'b'n'~'~~ if any', we~e"f~ll~-h~d~-~a-~'~ t~fs' Ci6~'~C~un~i-1 'g~ve .... ~="' ...... all persons present an. opportunity to hear or to be heard in respect to any matter relating to the work proposed,· the boundaries of the business promotfon distr~ct, the question of whether public convenience and necessity require such improvements, the question determining additional tax to be imposed upon those businesses in ~he business promotion district; the question of the uses to which the additional revenue derived from the additional tax shall be put and the extent oftaxes to be levied to Support said district; and WHEREAS., this City Council has received evidence relating to the 'proposed business promotion district and the benefits to the business license'holdersto be included in the proposed business promotion district, and is fully informed in t,he premises; -'NOW, THEREFORE, the City CounCil of the City of Bakersfield does HEREBY RESOLVE, FIND, DETERMINE AND ORDER as follows: Section I. Written or oral protest or objection has not been made by owners or representatives of the°businesses in the proposedarea which pay a majority· of the taxes within 'the area under the'general business license tax of the City of Bakersfield, or by businesses' which would pay a majority of the taxes within the City under the proposed tax. · Section II. Each and all oral and written protests and objections, if any, made or filed in the matter, b~ and the same are hereby overruled'and denied. Section III. Pursuant to Section 6.50.040 of the Municipal Code (Ord. No. 1741 N.S.') the boundaries of the business promotion district are hereby modified to include all of the area bounded by23rd Street on the north, Truxtun Avenue on the south, "G" Street on the west and "M" Street on the east. The business promotion district proposed to be formed and taxes proposed to be levied are hereby fixed and established as described in said resolution of intention and as herein modified, and reference is 2. hereby made .to said resolution of intention a.nd Chapter'6.50 of'the Municipal Code for a full description of said district, the boundaries of said district and as hereinmodified, the.taxes and for further particulars.· ... . · ' Section IV. The public convenienceand'.necessity require the formation of said business pro'motion district..' Section V. The business promotion 'distri~t~shall be created under application of Resolution No~ 65L68 a'nd'Ordinance No. 17'41 N.S,, and amendments thereto, of the City council of the City of Bakersfield. . =. Section VI. The City Council of the .City Of Bakers field has acquired jurisdiction to order the formation'.of the business 'promotion district described 'in said resolution of intention and does hereby .order the formation of said district. Reference is · hereby made to said Resolution of Intention No. 65-68. and to - 'Ordinance No. 1741 N.S.', and amendments thereto.." Said resolution and ordinance are on file in the office' of the .6ity·Clerk, and reference is hereby made thereto for the fulland detailed description of said business promotion district, except as said boundaries have' 'herein been-modified..· Section VII.. Pursuant to Ordinance No. 1741 N.S., as amended,.being Chapter 6.50 of the Municipal Code, the collection Of the additional tax for a business'licenSe for the. business promotion district shall'be made at the same time and-in the same manner as any other business license'tax.and all provisions;of Chapter 6.20 of.the Municipal Code relative to enforcement and · collection of business licenses are'.appli~able herein.~ Section VIII. The City Clerk is hereby directed, in the .time, form and manner provided by law,· tO publish and post notices of this resolution. Section IX.'
