RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BAKERSFIELD, CALIFORNIA, REPEALING
RESOLUTION OF INTENTION NO. 801 AND
ABANDONING PROCEEDINGS PURSUANT THERETO;
APPROVING A PROPOSED RESOLUTION OF INTENTION;
AND REQUESTING THE CONSENT OF THE BOARD.OF
SUPERVISORS OF THE COUNTY OF KERN TO THE
FORMATION OF THE ASSESSMENT DISTRICT, TO
THE ACQUISITIONS AND IMPROVEMENTS DESCRIBED
AND TO THE ASSUMPTION OF JURISDICTION
THEREOVER.

White Lane and Hughes Lane)
WHEREAS, in proceedings under the Municipal Improvement Act
of 1913 the City Council on August 15, 1966 adopted Resolution
No. 51-66 approving a proposed resolution of intention and requesting
the consent and approval of the Board of Supervisors thereto,
said proposed resolution of intention providing for certain
acquisitions and improvements and the district to be assessed to
pay the costs and. expenses thereof'to be located within the.
incorporated territory of the City of Bakersfield and also within
the unincorporated territory of the County of Kern; and
WHEREAS, the Board of Supervisors adopted on September 20, 1966
a resolution approving 'said proposed resolution of intention, the
acquisition, improvement and assessment district described therein
and the assumption of jurisdiction thereover bythe City Council
and officers of the city and the City Council on October 24, 1966
adopted said resolution of intention, Resolution of Intention No.
801; and
WHEREAS, since the adoption of Resolutionof Intention No.
801 the boundary between incorporated and unincorporated territory
within the proposed assessment district has been changed by the
annexation'~f territory tQ the city.~ the location within unincorporated
territory of a proposed drainage sump has been changed and certain
proposed work has been deleted and for these reasons the City Council
deems it advisable to repeal Resolution of Intention No. 801,-to
abandon proceedings initia~ed pursuant thereto and to initiate new
proceedings.
WHEREAS, the City Council has been presented with a new
form of a proposed resolution of intention under the Municipal
Improvement Act of 1913 for the acquisition and improvement of
certain lands, rights of way and easements within proposed Public
Improvement District No. 801-A'; and
WHEREAS, the proposed acquisitions and improvements and the
territory of the proposed assessment district are located both
within the incorporated territory of.the City of Bakersfield and within
the unincorporated territory'of the County of Kern.
NOW, THEREFORE, the City Council of the City of Bakersfield
DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows:
Section 1. Resolution of Intention No. 801 is hereby repealed
and proceedings thereunder are hereby abandoned.
Section 2. The public interest and convenience require and,
in the opinion of the City Council, the proposed acquisitions
and improvements are of such a character that they directly and
peculiarly affect property in the incorporated territory of said
city and in the unincorporated territory of said county and that
the purposes sought to be accomplished by the acquisitions and
improvements can. best be accomplished. by a single, comprehensive
scheme of work. The lands within the boundaries of .the proposed
assessment district, in the opinion of the City Council, will be
benefited by the proposed acquisition and improvement.
Section 3. The resolution of intention, in the new form
submitted to the City Council, is hereby approved as a proposed
resolution of intention. The Board of Supervisors of the County
of Kern is hereby requested to approve such proposed resolution
of intention and to consent to the proposed acquisitions and
improvements and to the formation of the assessment district,
all as described therein. .Said Board of Supervisors is further
requested to provide for payment of a contribution toward the
costs and expenses of said improvement substantially similar to
that heretofore provided in its resolution of September 20, 1966.
Section 4. The City Clerk is hereby directed to certify a
copy of this resolution, together with a copy of the proposed
resolution of intention referred to therein, and to file the
same with the Clerk of the Board of Supervisors of the County of
Kern.
