TO THE CONSTITUTION OF THE STATE OF CALIFORNIA .- FOR A TAX CREDIT TO RESIDENTS OF INCORPORATED CITIES ON THEIR COUNTY. PROPERTY TAX LEVIES, WHEREAS, a clear definition of respOnsibility'for various services between municipalities and county government does not exist. in lo~al government of California;'and :' ,. ~' ;- . WHEREAS, 'this confusion of responsibility has led to a · costly dhplicatiOn of services provided by bo'th municipalities..and countieS;· and ' WHEREAS, such duplication of services has resulted in instances Of unjust and inequitable taxation to'the .residents of incorporated Cities in order for.the counties to provide municipal- type services-to unincorporatedcountyresidents;and '~ 'WHEREAS, all County services, which are financed with funds derived-from co'untyWide taxeS,.should be made available to all.taxpayers of'a county on'th~ same basiS.,'or an equitable tax .credit returned to those taxpayers who do not.benefit from any specified.county services; and WHEREAS, incorporated'taxpayers recognize justified'obli- gations to ~heir county for services performed on their behalf as" county' residents, .but·protest unjust taxation for services~ they already provide·for themselves; and .. WHEREAS, present annexation statutes of the State Of California 'perpetuate this situation of costly duplication ,and tax ~\ · inequity;_ ~,nd WHEREAS, existing legislation empowers counties to estab- lish county service areas for unincor. porated. county residents for municipal services.receiVed; and WHEREAS, nties h~ve failed touti] ~ fully. such powers to create county service areas where needed; NOW.,'THEREFORE,'BE.IT~RESOLVED by the Council of the City of Bakersfield, as follows: That the League of California Cities adopt a resolution 'instructing its ExeCutive Committee to prepare an appropriate initiatiwe'meaSure to the Constitution' of-.the Stateof California for the.purpose of terminating unjust taxation imposed on incor- porated taxpayers by county ·governments. Accordingly, the initia- tive shall'provide that the State BOard of Equalization shall per- form in a supervisorial role to equalize the administration, col- ~.lection, and equiiy of such tax levy between incorporated and unin- 'corporated taxpayers in the total taXleVy o'f 'the Counties 'of California. BE IT FURTHER RESOLVED, that a tax credit shall be stipu- lated by'the Board of Equalizatioh to city'taxpayers against each county of California property tax bill for any services that are not provided on a uniform basis both withinand.without the cities in such Count ies. BE IT FURTHER RESOLVED that the LeagUe seek passage of this initiative measure by the June, t970.
