HomeMy WebLinkAboutRES NO 65-68RESOLUTION NO'. 65-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY' OF BAKERSFIELD, C~LIFORNIA DECLARING ITS INTENTION TO ESTABLISH A BUSINESS PROMOTION DISTRICT IN THAT PORTION OF DOWNTOWN BAKERSFIELD BORDERE'D BY 23RD STREET ON THE NORTH, TRUXTUN AVENUE ON THE SOUTH, "F" STREET ON THE WEST AND "N" STREET ON THE EAST, DETERMINING THAT ADDITIONAL TAX SHALL BE IMPOSED UPON THOSE BUSINESSES IN THE BUSINESS PROMOTION DISTRICT; DETERMININg' THE USES TO WHICH THE ADDITIONAL REVENUE DERIVED FROM THE ADDITIONAL TAX SHALL BE PUT AND FIXING THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS TO THE FORMATION OF THE DISTRICT OR THE EXTENT OF TAXES TO BE LEVIED TO SUPPORT SAID DISTRICT., OR BOTH, AND WHETHER PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE FORMATION OF SUCH A DISTRICT AND GIVING NOTICE THEREOF. ~HEREAS, this City Council proposes to take proceedings under the BUSINESS PROMOTION DISTRICT ORDINANCE of the City of Bakersfield (Chapter 6.50 of the Municipal Code of the City of Bakersfield), for the.'~formation of a business promotion district as'hereinafter described; and WHEREAS, this City Council proposes after notice and hearing, to find and determine by no less than a majority vote of'all the members thereof, t'hat the public convenience and necessity require the formation of such a district. NOW,-THEREFORE, the City Council of the.Ci~y'0f Bakersfield, DOES HEREBY RESOLVE, DETERMINE AND 'ORDER as follows: Section ,1. The public interest and convenience require and it'is the intentio~ of the City CoUncil-of the City of Bakersfield to order the formation of a business promotion district pursuant to Chapter 6.50 of the MUnicipal Code of. the 'City of Bakersfield, the description of which shall be as follows, to 'wit: A parcel of land situate in the CoUnty of Kern, State of California and being a portion of Section 25, Township 29 South, Range 27'East, M.D.B. & M. and Section 30, Township 29 South, Range 28 East, M.D.B. & M., described as follows: Beginning at the northwest corner as said LOt is shown on a map designated as "Map of the City'of Bakersfield, Kern County, California", filed for record November 25, 1898, in the office of the County Recorder of said County;' ThenCe (1) Nly, along a line parallel to the west right of way line of "G" Street, to a point -132.00 feet Nly of the north right of way line of 23rd Street; Thence (2) Ely along a ·line, parallel to said north right of way line of 23rd Street, to a point 132.00 feet Ely of the east right of way line of "M''· Street; Thence (3)' ,S, MI~, along a line parallel to the 'east right of way line of Street, to a point 132 feet Sly of the south right of way line of Truxtun Avenue; .Thence (4) Wly along a line, parallel to the south right of .way line of said Truxtun Avenue, to a point 132.00 feet Wly of said Wly right of way line of "G" Street; Thence (5) Nly along a line parallel to Said Wly right of way line of "G" Street, ·to point of beginning. (See map marked Exhibit #1 attached to and made a part of this ~esolution the same as if set forth in full herein.) Section 2. Notice is hereby given that on August 19, 1968 at the hour'of 8:00 P.M. in the Council Chambers of said City Council at the City Hall, 1501 Truxtun Avenue, in said City,are the day, hour and place fixed for protests and objections by the City Council. Any and all persons having any protest or objection to the formation of said proposed district, the purposes of said proposed' district, or the proposed taxesto be levied, may appear before said City Council at said hearing,. and'show cause why said proposed business.promotion district should not be formed or carried out in accordance with this resolution of intention. Protests orobjections must be in writing and must be delivered to the City Clerk Of said city, not later than the day and hour Set for said hearing. Section 3. Notice is further given Chat at the previously mentioned day, hour and place, the.City Council will also hold a public hearing on the question of whether public convenience and necessity require the formation of such district. 'Notice of The .... public hearing provided for by this section shall be published, posted .and mailed by the same means, at.the same time and in the same manner hereinafterprovided for the publication of this resolution,. and the posting and mailing of notice of adoption or passage thereof. ~Section 4. The uses to which the additional revenue derived from the additional tax for a business license will be put shall be as provided in Chapter 6.50 of the Municipal Code of the City of Bakersfield. Such uses shall include, but not be limited to those activities, Uses and purposes set forth more fully in Section 6.50.030 of the Municipal Code of the City of Bak'ersfieid and shall include,"but not be limited tO the .following: (a) Decoration of any public. place in the district. (b) ,Promoti6n·of public events which are to take place on or in public places in such district. (C) Furnishing of'mUsic in any public. place in the district. .(d) The ·acquisition, construction or maintenance o~ public improvements, including parking lots, benefi'ting the district. (e). Financial assistance to the Bakersfield Community Redevelopment Agency on projects within the .Business Promotion · District; (f) The general advertising of the district, and'developmentI''' of·means to increase business activity in the ·district. SectiOn 5. That the establishment of the business promotion district as proposed in this resolution shall cause an additional tax for business licenses for the businesses'conducting their activities in the herein-described district and that such increase shall be in accordance with the schedule presently'provided in Chapter 6.50 of the Municipal Code of the City 6f Bakersfield as now more specifically set forth'in Section 6.50,050'of said Municipal Code. Section. 6. This City Council shall have sole discretion as to how this revenue derived from the tax is to be used within the scope of the purposes set forth in Ordinance ~No. 1741 N.S. and this resolution;'however, this City Council may appoint existing advisory boards or commissions'to 'make recommenda- tions as to its'use or this City Council may create a new advisory board or commission for the purpose. Section 7. Said City Clerk is hereby di'rected..to mail notices of the adoption of this resolution, such notice to be given in the time, form and manner provided by'law as specifically set'out in Section 6.50.020 of the Municipal Code of said City. Section 8. THE BAKERSFIELD CALIFORNIAN, a newspaper o~ general circulation, published and circulated in the City ~f Bakersfield, is hereby selected as the newspaper in which this resolution shall be published and, except when otherwise ordered by the City Council, in which all other publications pursuant to this resolution of intention shall be made. That City Clerk is hereby directed to certify to the adoption of this resolution and to cause 'Sa~d resolution to be published in the manner provided by law. Section 9. Said proposed district, its creation, implementa- tion and operation are, to be done under and pursuant to Chapter '·6..50 of th'e Municipal Code of the City of Bakersfield. -o0o I HEREBY.CERTIFY that the foregoing ReS~lut~on.
