HomeMy WebLinkAboutRES NO 51-66RESOLUTION NO. 51-66 RESOLUTION OF THE CITY COUNCIL OF THE CITY~OF BAKERSFIELD, CALIFORNIA, APPROVING A PROPOSED RESOLUTION OF INTENTION AND REQUESTING THE CONSENT OF THE BOARD OF SUPERVISORS OF THE COUNTY OF KERN TO THE FORMATION OF THE ASSESSMENT DISTRICT, TO THE ACQUISITIONS AND IMPROVEMENTS DESCRIBED AND TO THE ASSUMPTION OF JURISDICTION THEREOVER. (Public Improvement District No. 801, White Lane and Hughes Lane) WHEREAS, the City Council has been presented with the form of a proposed resolution of intention under the Municipal Improvement Act of 1913' for the acquisition and improvement of certain lands, rights of way and easements within proposed Public Improvement District No. 801; and WHEREAS, the proposed acquisitions and improvements and the territory of the proposed assessment district are located both within the incorporated territory of the City of Bakersfield and within the unincorporated territory of the County of Kern. NOW, THEREFORE, the City Council of the City of Bakersfield, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. The public interest and convenience require and, in the opinion of the City Council, the proposed acquisi- tions and improvements. are of such a character that they directly and peculiarly affect property in the incorporated territory of said city and in the unincorporated.territory of said county and that the purposes sought to be accomplished by the acquisi- tions and improvements can best be accomplished by a single, comprehensive scheme of work. The lands within the boundaries of the proposed assessment district, in the opinion of the City -1- Council, will be benefited by the proposed acquisition and improvement. Section 2. The resolution of intention, in the form submitted to the City Council, is hereby approved as a proposed resolution of intention. The Board of Supervisors of the County of Kern is hereby requested to approve the proposed resolution of intention and to consent to the proposed acquisitions and improvements and to the formation of the assessment district, all as described therein. Said Board of Supervisors is further requested to provide for payment of a contribution by said county in an amount equal to the sum of (i) the contract cost for the construction, upon all streets and highways located within the unincorporated territory of said county, of all paving and curbs located more than 20 feet inside the face of the sideline curbs and (ii) a pro rata share of the estimated incidental expenses of said improvements, such share to be in the same proportion as the amount of the contract cost to be con- tributed by the county shall bear to the total contract cost of all improvements. Section 3. The City Clerk is hereby directed to certify a copy of this resolution, together with a copy of the proposed resolution of intention referred to therein, and to file the same with the Clerk of the Board of Supervisors of the County of Kern.
