HomeMy WebLinkAboutRES NO 172-98RESOLUTION A RESOLUTION AUTHORIZING PARTICIPATION IN A STATE GRANT PROGRAM RELATING TO IMPOUNDING VEHICLES. WHEREAS, national statistics show that drivers of vehicles that have either a suspended or revoked license are involved in fatal collisions four (4) times more often and injury crashes six (6) times more often than licensed drivers; and WHEREAS, the State of California, Office of Traffic Safety, has established a grant program to encourage cities to impound vehicles being driven by unlicenced drivers; and WHEREAS, the Bakersfield Police Department applied for such grant and has been selected to participate in the program and receive state funding; and WHEREAS, the City of Bakersfield currently has a mandatory tow program and provides, within its Cost Recovery Program, an impound fee; and WHEREAS, during calendar year 1997, the City of Bakersfield General Fund received approximately $144,000 in Vehicle Code 14601 (driving on suspended license) administrative recovery fees and approximately $94,514 in vehicle asset forfeiture funds; and WHEREAS, acceptance of the grant monies from the State of California, Office of Traffic Safety will enable the Bakersfield Police Department to purchase necessary equipment to track all Vehicle Code 14601 (driving on suspended license) and Vehicle Code 12500(a) (driving without a license) violators, and fund three (3) new police officer positions, one (1) clerk typist position, and one (1) police service technician position; and WHEREAS, in order to be eligible to receive grant monies from the State of California, Office of Traffic Safety, the City of Bakersfield must establish a Special Traffic Offender Enforcement Account into which the traffic impound fee charged by the City of Bakersfield under its cost recovery program relating to offenses under Vehicle Code 14601 (driving on suspended license and Vehicle Code 12500(a) (driving without a license)will be deposited; and WHEREAS, said program is for a three (3) year period, with grant monies funding one hundred percent (100%) of the program in the first year, fifty percent (50%) of the program in the second year, and zero in the third year so as to result in a self-sustaining city program. Page 1 of 3 NOW, as follows: 1. 2. THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield The above recitals and findings are true and correct. It is in the best interests of the City of Bakersfield to participate in the State of California, Office of Traffic Safety program and accept state grant funding for stricter enforcement of Vehicle Code violations 14601 and 12500. A Special Traffic Offender Enforcement Account is hereby established and designed exclusively for impound fees relating to violators of Vehicle Code 14601 and 125000(a). The traffic impound fee charged by the City of Bakersfield under its cost recovery program will hereafter be deposited into the Special Traffic Offender Enforcement Account until further Resolution by the Bakersfield City Council or termination of the Grant Program as referenced herein, whichever occurs first. ..... oo000oo .....
