A RESOLUTION OF THE COUNCIL OF THE
CITY OF BAKERSFIELD ADOPTING THE
STREET CUT WORKMANSHIP AND
PERFORMANCE WARRANTY FEE
WHEREAS, Chapter 12.16 of the Bakersfield Municipal Code requires that the
City Council adopt a resolution establishing a workmanship and performance warranty
fee for street cuts; and
WHEREAS, this workmanship and performance warranty fee was last amended
on October 24, 2007; and
WHEREAS, this workmanship and performance fee is intended to pay for the
cost of resurfacing a City street subject to street cuts with the fee based upon a
minimum of 100 feet; and
WHEREAS, Bakersfield Municipal Code Section 12.16.150 requires that the
Street Cut Workmanship and Performance Warranty Fee be adjusted annually by the
ENR Annual Construction Cost Index (Los Angeles), as published by Engineering News
Record, McGraw-Hill Companies; and
WHEREAS, the Street Cut Workmanship and Performance Warranty Fee is
based upon pavement in "good" condition as defined by the "Pavement Index" as
established in the City's Pavement Management System; and
WHEREAS, the proposed fee increase from $19.90 per lane-foot to $20.66 per
lane-foot is based upon the ENR Annual Construction Cost Index (Los Angeles), as
published by Engineering News Record, McGraw-Hill Companies ;and
WHEREAS, the minimum pavement degradation fee will be $2,066 because 50
feet is the practical minimum of pavement that must be placed on either side of a trench
patch to assure the integrity of the roadway; and
WHEREAS, the City Council desires to adjust this fee to recover the City of
Bakersfield's costs in resurfacing streets.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
The above recitals are true and correct and are incorporated herein.
2. That the fee schedule for the workmanship and performance warranty fee
set forth as Exhibit "A" is hereby approved and adopted.
3. The effective date of this resolution shall be November 10, 2008.

NOTICE OF PUBLIC HEARING
BEFORE THE CITY COUNCIL OF THE CITY OF BAKERSFIELD
NOTICE IS HEREBY GIVEN that a public hearing accepting testimony will be held before the
Council of the City of Bakersfield on November 5, 2008, at 5:30 pm, or as soon thereafter as the
matter may be heard, in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield,
California, 93301, to consider adjustment of the Street Cut Workmanship and Performance Warranty
Fee, in accordance with Chapter 12.16.150 of the Bakersfield Municipal Code.
The proposed Workmanship and Performance Warranty fee schedule is as follows (only changes are
noted below):

Permitees with One Year Warranty:

Pavement in "fair" condition
Permitees with Twelve Year Warranty:

Any person challenging in court the decision made at the conclusion of such public hearing
may be limited to raising only those issues raised at such hearing, or in written correspondence
delivered to the City of Bakersfield prior to the close of such hearing.
