RESOLUTION AMENDING THE CITY OF
BAKERSFIELD NON-DISPOSAL FACILITY
ELEMENTS OF THE COUNTYWIDE INTERGRATED
WASTE MANAGEMENT PLAN
RECITALS
WHEREAS, Public Resources Code Section 41732 requires the
amendment of the Non-Disposal Facility Element of the adopted City of
Bakersfield Integrated Waste Management Plan whenever necessary to include
the identification of specific locations or general areas for new solid waste
facilities or the expansion of any existing solid waste facilities that will be needed
to implement the City's source reduction and recycling element; and
WHEREAS, The Mount Vernon Avenue Composting and Recycling
Facility, located at 2601 South Mount Vernon Avenue, is incorrectly identified in
the City of Bakersfield Integrated Waste Management Plan Non-Disposal Facility
Element as the Bakersfield All America City Recycling Center, located at 2600
South Mount Vernon Avenue in old records; and
WHEREAS, The City of Bakersfield Non-Disposal Facility Element needs
to be amended to reflect the correct name and location of this facility; and
WHEREAS, The Solid Waste Division has prepared a report
recommending that this City Council make a finding that the Mount Vernon
Avenue Composting and Recycling Facility is in conformance with the City of
Bakersfield Non-Disposal Facility Element; and
WHEREAS, The City Clerk has caused notice to be duly given of a public
hearing in this matter in accordance with law, as evidenced by the affidavit of
publication and the affidavit of mailing on file with the City Clerk; and
WHEREAS, At this public hearing, this City Council duly amends the
NDFE, approving the correction of the Mount Vernon Avenue Composting and
Recycling Facility name and location and the report and recommendations of the
Solid Waste Division, and all interested persons were given the opportunity to
address, and were heard by this City Council; and
WHEREAS, All persons desiring to be heard in said matter have been
duly heard, and this -City Council having considered all testimony presented
during said public hearing and the report and recommendations of the .Solid
Waste Division having been concluded; and

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Bakersfield, as follows:
1. This City Council finds that the facts recited herein above are
true and further finds that this City Council has jurisdiction to consider,
approve and adopt the subject of this Resolution.
2. This City Council finds and determines that the California
Environmental Quality Act of 1970, the State CEQA Guidelines and the
City of Bakersfield Guidelines do not apply in conjunction with said hearing
and the considerations of this project.
3. This City Council finds and determines and hereby amends
the NDFE to correct the information from Bakersfield All America City
Recycling Center, located at 2600 South Mt. Vernon Avenue to the Mount
Vernon Avenue Composting and Recycling Facility, located at 2601 South
Mt. Vernon Avenue.
4. The City Clerk shall cause the attached Notice of Exemption
to be filed.
5. The City Clerk shall also cause copies of this Resolution to
be sent to the following:
