A RESOLUTION OF THE COUNCIL ORDERING THE VACATION OF A
30-FOOT WIDE PUBLIC ROAD EASEMENTS DEDICATION SOUTH OF
CASA LOMA DRIVE AND EAST OF LOTUS LANE.
WHEREAS, Bakersfield Pacific Associates II, the property owner, has submitted
a request for the 30-foot wide public Road Easement as dedicated per Grant Deed
15542, book 2062 in page 1, to be vacated; and
WHEREAS, the public Road Easement is eligible for summary vacation per Section
8334 of the Streets and Highways Code which authorizes the City Council to summarily
vacate a street excess right of way of a street which is not required for street purposes;
and
WHEREAS, for the above-described project, it was determined that the proposed
vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines
(General Rule) in that there is no possibility that the proposed action could have a
significant effect on the environment; and
WHEREAS, Planning department approved the vacation on October 3, 2008 per
local ordinance and found to be consistent with the Metropolitan Bakersfield General
Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein.
2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and
Highways Code of the State of California.
3. The Council orders the vacation of public Road Easement, located south of Casa
Loma Drive and east of Lotus Lane in the City of Bakersfield, County of Kern, State of
California, more particularly described in Exhibit "A" and shown in Exhibit "B", attached
hereto and made part hereof.
4. The City Clerk shall certify to the passage of this resolution and shall cause a
certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in
the Office of the County Recorder of the County of Kern, California

Street Right-of--way Vacation
The South 30 feet of the following described parcel of land located in the Southeast quarter of the
Northeast quarter of Section 8, Township 30 South, Range 28 East, Mount Diablo Base and
Meridian, in the City of Bakersfield, County of Kern, State of California, per grant deed recorded
April 1, 1953 in Book 2062, Page 1 as Instrument No. 15542, filed in the office of the Kern
County Recorder:
Beginning at a point on the North line of said Southeast quarter of the Northeast quarter,
240 feet East from the Northwest corner thereof; thence South and parallel with the West
boundary line of said Southeast quarter of the Northeast quarter, 186.25 feet; thence
Easterly on a line parallel with the Northerly boundary line of the Southeast quarter of the
Northeast quarter of said Section, a distance of 414.3 feet to a point on the line dividing
the East half from the West half of the Southeast quarter of the Northeast quarter of said
Section; thence Northerly along said last named line, a distance of 186.25 feet to the
point of its intersection with the Northerly boundary line of the Southeast quarter of the
Northeast quarter of said Section; and thence Westerly thereon 414.2 feet to the Point of
Beginning.
Containing 12,428 square feet, more or less.
