SUBJECT: Coustntction Defect Litigation
C"r the past S to 10 years th m hes been an epidemic of defect litigaanon in Southeta C"braia.
Recently this epidemic bas spretd to Central C"rain.ia,specifically the FreWWClavls areas.
It should be noted that that are two "ft of perceiived defects in housing consttuedon;. state
building code requacments, which are MMMM standards and expected worbmwship levels,
which may Or may not be covered by The building ems. Each home is a different case, and the
merits of nay litigation between dw homeowner and DevelopevrContractor will be ascertained by
the courts.
The City's interest In this type of littgatiOa is to assure that, If there is a court settlement and
dime are stag geda difts that the home in question will be repaired, or al the very
least any future prospective buyer vi-11 be nodficd of the defects. In order to protect future hone
buyers in Clovis one of the following courses of action should be followed:
1. The Itotneowrer repairs the defect with satticmeat hinds(tray require building permit).
Z. The owner lists defects on A disclosure su t went to potential lenders or buyers.
