HomeMy WebLinkAboutRES NO 9-84RESOLUTION NO. 9-84 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND APPROVING SEGMENT II OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 2-83). WHEREAS, the Council of the City of Bakersfield referred Segment II of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, in accordance with the Planning Commission of the City of Bakersfield, the provisions of Section 65351 of the Government Code, held a public hearing on December 15, 1983, on Segment II of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such the Land Use Element of Plan is Segment II of the proposed amendment to the Bakersfield Metropolitan Area General as follows: SEGMENT II: PACIFIC SCENE PROPERTIES OF FRESNO, INC. has applied to change the Medium Density Residential designation to High Density Residential for 2.2 acres located on the southeast corner of 40th and "Q" Streets, as shown on map. WHEREAS, for the above-described Segment, an Initial Study was conducted, and it was determined that the proposed project would not have a significant effect on the environment, and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepara- tion and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 132-83 have been duly followed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 83-83 on December 15, 1983, the Planning Commission recommended approval and adoption of Segment II by this Council, subject to P.U.D. (Planned Unit Development) zoning as more specifically set forth below; and WHEREAS, the Council of accordance with the provisions of Code, conducted and held a public the above-described Segment II of Land Use Element of the the City of Bakersfield, in Section 65355 of the Government hearing on January 18, 1984, on the proposed amendment to the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield California, a newspaper of general circulation. NOW, THEREFORE, BE IT HEREBY RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. approved 2. The Negative Declaration for Segment II is hereby and adopted. 3. The report of the Planning Commission, including all reports and papers relevant thereto, transmitted by maps and the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. The City Council hereby approves and adopts Segment II of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, subject to P.U.D. (Planned Unit Development) zoning as detailed in Planning file No. 4025 and containing the following limitations: a. Sixty small apartment units contained in four two-story building structures. b. Common, centrally located recreational (including swimming pool) and laundry facilities. c. One vehicle access point each to 40th Street and "Q" Street in compliance with City Public Works Department requirements. 5. That this Segment II of the proposed amendment to the Land Use Element be combined with other segments approved and adopted by this City Council, as set forth in separate resolutions, to form a single Land Use Element Amendment, 2-83. .......... o0o ..........
